Trump Spurned by 30 Companies as He Seeks Bond in $454 Million Judgment

Donald J. Trump’s lawyers said in a court filing that he faces “insurmountable difficulties” as he tries to raise cash for the civil fraud penalty he faces in New York.

Donald J. Trump’s lawyers disclosed on Monday that he had failed to secure a roughly half-billion dollar bond in his civil fraud case in New York, raising the prospect that the state could seek to freeze some of his bank accounts and seize some of his marquee properties.

The court filing, coming one week before the bond is due, suggested that the former president might soon face a financial crisis unless an appeals court comes to his rescue.

Mr. Trump has asked the appeals court to pause the $454 million judgment that a New York judge imposed on Mr. Trump in the fraud case last month, or accept a bond of only $100 million. Otherwise, the New York attorney general’s office, which brought the case, might soon move to collect from Mr. Trump.

Still, even if the higher court rejects his appeal, Mr. Trump is not entirely out of options . He might appeal to the state’s highest court, quickly sell an asset or seek help from a wealthy supporter.

Mr. Trump’s team has also left the door open to exploring a bankruptcy for corporate entities implicated in the case, according to people with knowledge of the discussions. That option, however, is politically fraught during a presidential race in which he is the presumptive Republican nominee, and for now it appears unlikely.

The judge in the civil fraud case, Arthur F. Engoron , levied the $454 million penalty and other punishments after concluding that Mr. Trump had fraudulently inflated his net worth to obtain favorable loans and other benefits. The case, brought by the New York attorney general, Letitia James, has posed a grave financial threat to Mr. Trump.

The former president has been unable to secure the full bond, his lawyers said in the court filing on Monday, calling it a “practical impossibility” despite “diligent efforts.” Those efforts included approaching about 30 companies that provide appeal bonds, and yet, the lawyers said, he has encountered “insurmountable difficulties.”

The company providing the bond would essentially promise to cover Mr. Trump’s judgment if he lost an appeal and failed to pay. In exchange, he would pledge cash and other liquid assets as collateral, and he would pay the company a fee as high as $20 million.

But Mr. Trump does not have enough liquidity to obtain the bond. The company would require Mr. Trump to pledge more than $550 million in cash and securities as collateral — a sum he simply does not have.

Although the former president boasts of his billions, his net worth is derived largely from the value of his real estate, which bond companies rarely accept as collateral. Mr. Trump has more than $350 million in cash , a recent New York Times analysis found, far short of what he needs.

He might have to post an appeal bond worth more than $454 million — possibly above $500 million, to reflect the interest he will owe — in order to prevent Ms. James from seizing his assets on March 25.

Under the law, Ms. James could have moved to collect from Mr. Trump as soon as Justice Engoron ruled, but she offered a 30-day grace period, until March 25. It is unclear whether she will provide Mr. Trump extra time or if she will move swiftly to collect. Nor is it clear whether the appellate court will rule on his plea for help before the deadline.

Mr. Trump could also seek to appeal to New York’s highest court, and it is unclear whether Ms. James will hold off on the seizure while he pursues that route.

A spokeswoman for Ms. James did not immediately respond to a request for comment.

Mr. Trump has denied all wrongdoing and claimed that Ms. James and Justice Engoron, both Democrats, are out to get him.

“This is a motion to stay the unjust, unconstitutional, un-American judgment from New York Judge Arthur Engoron in a political witch hunt brought by a corrupt attorney general,” Steven Cheung, a spokesman for Mr. Trump’s campaign, said in a statement. “A bond of this size would be an abuse of the law, contradict bedrock principles of our republic, and fundamentally undermine the rule of law in New York.”

The looming deadline could not come at a worse time for Mr. Trump. He also faces four criminal indictments, including one in Manhattan that is tentatively set for trial in mid-April.

And just last week he finalized a $91.6 million bond in a defamation case he recently lost to the writer E. Jean Carroll, a costly deal that drained him of precious cash.

Mr. Trump, who obtained that bond from the insurance giant Chubb, pledged an investment account at Charles Schwab as collateral, records show. He most likely pledged more than $100 million in cash and stocks and bonds that he could sell in a hurry — investments that are now no longer available for him to use in the civil fraud case.

A nearly $500 million bond, Mr. Trump’s lawyers wrote on Monday, “is unprecedented for a private company.”

Yet Mr. Trump’s legal team “devoted a substantial amount of time, money, and effort” to finding one, according to a court filing by Alan Garten, the top lawyer at Mr. Trump’s family business.

Using four separate brokers, the lawyers approached more than two dozen companies that provide appellate bonds, including Chubb and Berkshire Hathaway, the conglomerate run for decades by Warren E. Buffett, Mr. Garten said. He added that most of the companies were either unable or unwilling to handle a bond of this size, and that none were willing to accept property as collateral.

Their best bet appeared to be Chubb, but within the past week, Chubb notified Mr. Trump’s lawyers that it, too, could not accept property as collateral.

“This presents a major obstacle,” Mr. Garten wrote.

Mr. Trump’s company has not ruled out the possibility of having the corporate entities declare bankruptcy, the people with knowledge of the discussions said. That move would automatically halt the judgment against those entities and prevent Ms. James from seizing some of the former president’s properties.

But Mr. Trump, scarred from an experience in the 1990s when some of his companies filed for bankruptcy, is likely to balk at a filing.

And even if he supported it, bankruptcy — which Mr. Trump used to describe derisively as “the b-word” — might not be a cure-all, legal experts said. Seeking court protection could trigger defaults in loans he holds, and would most likely set off litigation over whether Mr. Trump is still responsible to pay his company’s debts.

Mr. Trump’s lawyers on Monday also submitted a filing from one of his insurance brokers, Gary Giulietti, who said his team had for several weeks been “scouring the market” for a bond.

“Simply put, a bond of this size is rarely, if ever, seen,” he wrote.

Mr. Giulietti, who testified as an expert witness at the trial, also occasionally golfs and dines with Mr. Trump.

In his decision, Justice Engoron criticized his testimony, saying that in more than 20 years on the bench, he had never encountered an expert witness who “not only was a close personal friend of a party, but also had a personal financial interest in the outcome of the case.”

DIFS Orders Sigue Corp. to Cease Money Transmission Activities

(LANSING, MICH) — Last week, the Michigan Department of Insurance and Financial Services (DIFS) ordered Sigue Corp. to cease engaging in money transmission activities in Michigan as the company can no longer responsibly serve customers due to its declining financial position. Thirty-nine states, Puerto Rico, and the District of Columbia coordinated to issue this consent order.

“This order is the result of a coordinated effort between regulators across the country, with assistance from the Money Transmitter Regulators Association and the Conference of State Bank Supervisors, to act quickly to protect consumers in Michigan and nationwide,” said DIFS Director Anita Fox . “Michiganders who are owed funds by Sigue should file a claim with DIFS . If you have questions, please call us Monday through Friday 8 a.m. to 5 p.m. at 877-999-6442 or email [email protected] .”

Sigue is a state-regulated money transmission company licensed in Michigan and 48 other states. Money transmission companies are generally used to send money via electronic checks, money orders, travelers checks, wire, and other methods. Over the past several months, Sigue experienced significant financial deterioration. The company failed to complete multiple money orders and transmissions and to maintain adequate net worth and permissible investments to cover outstanding liabilities, both of which violate state money transmission law. Many customers are still waiting for their funds. In Michigan, about 120 consumers are impacted.

The consent order requires the company to preserve and provide access to all books and records, including information on impacted customers. States will use the company's signed declarations to file bond claims on behalf of impacted customers. The state surety bond claim process is designed to help make impacted consumers whole.

Mission Moscow : A Conversation with Evgeny Kozlov

Mr. Evgeny Kozlov, Deputy Head Mayor of Moscow Government and Chairman of the Moscow City Tourism Committee, who has come to the city to attain BLTM, the annual prestigious travel event at the Leela Ambience Convention Centre, Delhi spoke with TW Editor Anirban Dasgupta on his vision and goal with the all-new tourism initiatives in Moscow.  

The bond between India and Russia has a long history of culture, literature, love, and of course politics. But recently, there has also been a lot of talk about Gastronomical tourism. Any personal experience with this?

My personal take on the bond between India and Russia stems from my recent experience of trying authentic Indian cuisine in Moscow. I thoroughly enjoyed the spicy flavours of the Curry dish I tried and it left a lasting impression on me. This made me appreciate the cultural exchange between our two countries even more. I believe that Moscow, being a culinary hub, is a great place for people from all over the world, including Indian visitors, to immerse themselves in our rich history and culture. It’s a unique experience that brings people together and showcases the diversity of the gastronomic universe. Moscow has a thriving food scene with various international cuisines to explore, from Chinese to South African and Latin American. This culinary diversity reflects the open-mindedness and curiosity of the Russian people when it comes to trying new types of food. Moscow truly has something for everyone, and I encourage Indian tourists to come and indulge in this gastronomic journey.

  How optimistic are the post-pandemic recovery figures?

After the Covid-19 pandemic, we have witnessed a remarkable recovery in tourism in Moscow. In fact, we have been able to restore 90% of the pre-pandemic tourist flow. In the first half of 2023, almost a million foreign tourists visited Moscow, with over 600,000 of them arriving during the summer season. Among the non-CIS countries, China has led the way in terms of tourist traffic, followed by Iran, the United Arab Emirates, Turkey, and India. Prior to the pandemic, India’s tourist flow was steadily growing at a rate of 12-15% annually. Although we faced challenges during the pandemic, we have now put in place all the necessary conditions for a successful recovery. Moscow is known for hosting numerous international exhibitions, forums, congresses, and conferences, attracting approximately 3.6 million business visitors in the past year alone. Among these visitors, India ranks third in terms of foreign business tourists in Moscow. To further promote tourism, we have initiated the MICE Ambassadors training program in India, which aims to assist Indian businesses in exploring opportunities and selecting relevant events in Moscow.

  Can you please share your vision for future tourism development in Moscow?

Thank you for asking this question. I have a multi-faceted vision for the future tourism development in Moscow.

Firstly, I believe that tourism should provide a personal and authentic experience for each individual. Therefore, customization of experiences is crucial. For business tourists, we aim to offer special infrastructure facilities that cater to their specific needs and requirements. We are closely collaborating with infrastructure providers to ensure seamless experiences for those visiting Moscow for business purposes. On the other hand, when it comes to leisure or family tourists, we recognize the importance of providing a support system and guidelines for those traveling with their families, especially children. We are working with museums, theatres, and restaurants to customize their services and products to cater to tourists of all ages, including children. Furthermore, I envision rearranging tourism in Moscow to encourage visitors to delve into the history and heritage of our country. A significant part of my tourism goal is to motivate and inspire the youth and younger generations to travel to Russia. This involves providing affordable pricing for accommodations, entertainment, museums, and other attractions.

We are already constructing tailor-made infrastructure that specifically targets the young generation in Russia, and by next year, we plan to extend and promote these offerings to international young visitors as well. By rebranding the image of Moscow as a destination for longer stays, relaxation, and enjoying various facilities, we aim to change the perception that it is merely a transit or stop-over city. Lastly, the beautiful weather in Moscow during the summer months provides an opportunity to create delightful memories for tourists. I want every visitor to experience the sunshine, green landscapes, parks, cafes, restaurants, swimming pools, and sports facilities that Moscow has to offer during this time.

In summary, my vision for the future of tourism in Moscow revolves around creating customized travel experiences for every type of traveller.

How easy or difficult is it to get a Visa for an Indian Tourist at present?

Acquiring a Visa for Indian tourists has become easier with the introduction of the e-visa system. Since its launch in August 2023, more than 30,000 tourists have already utilized this system. The e-visa offers several advantages over traditional visas, such as avoiding the need to visit consulates or embassies. The application process only requires a digital photograph and a scan of the passport data page. The e-visa has a validity period of 60 days from the date of issuance, with a maximum stay of 16 days in Russia. This convenient and streamlined process is available to citizens of 55 countries, including India. Indian tourists are currently ranked third in terms of business travellers from outside the CIS countries visiting Moscow.

Moscow, Idaho, population 24,000, is a city in Northern Idaho near the state border with Washington. Settlers came here first in 1871, mostly drawn by the rich grassland for grazing and seemingly limitless timber for building. The precise origin of the name of the city is not known. One story is that there was a Russian immigrant who took the initiative of filing for a postal permit and asked that the town be named after his home town in Russia. It is intended to be of interest to existing  TRISCO  boards, and those responsible for managing governance systems and processes within non-life insurance business.

PURPOSE OF GOVERNANCE

Governance is based on a set of principles that has developed over time to meet new challenges in areas such as: risk, finance, quality, probity, commerce and reputation. The current ‘rules’ and reactions to these challenges can usually be traced back to an initiating principle. Understanding these principles helps those tasked with developing appropriate governance to apply sensible solutions.

Governance initially started to develop as the management of organization’s separated from their ownership. As business grew more sophisticated and more stakeholders became involved in organizations, governance started to develop as a means of looking after their interests. Custom and practice, advisory codes, the law and the compliance requirements of Insurance Commission, other governing bodies, lenders and investors started to shape the governance structures and systems we know today.

Governance should deliver a focus on:

  • Vision – a shared understanding of what it is the organization is trying to achieve and the difference it intends to create.
  • Strategy – the planned achievement of the vision of the company.
  • Leadership – the means by which the organization will take forward the strategy.
  • Assurance – comfort and confirmation that the organization is delivering the strategy to plan, manages risk to itself and others, works within the law, delivers safe, quality services and has a proper grip on resources of all kinds and for which it is accountable.
  • Probity – that the organization is behaving according to proper standards of conduct and acts in an open and transparent manner.
  • Stewardship – that the organization applies proper care to resources and opportunities belonging to others but for which it is responsible, or can effect.

  • The confidentiality of data pertaining to individuals will be protected as follows:
  • The data recipient will not release the names of individuals, or information that could be linked to an individual, nor will the recipient present the results of data analysis in any manner that would reveal the identity of individuals.
  • The data recipient will not release individual addresses, nor will the recipient present the verified data in any manner that would reveal individual addresses.
  • Both parties shall comply with all State laws and regulations governing the confidentiality of the information that is the subject of this Agreement.
  • The data recipient will not release data to a third party without prior approval from the data provider.
  • The data recipient will not share, publish, or otherwise release any findings or conclusions derived from analysis of data obtained from the data provider without prior approval from the data provider.
  • The data recipient affiliates, subsidiaries, contractors, partners, agents and representatives, intermediaries, industry associations, and other third parties access to personal information of the data provider, including this form, for purposes of marketing, sales or promotional information campaigns, and provision of any products, services, or offers through mail/email/SMS/telephone, or any type of electronic facility.
  • Data transferred pursuant to the terms of this Agreement shall be utilized solely for the purposes set forth in the “Agreement”.

By signing this form, I hereby certify that I have read and understood the foregoing and this consent remains valid and binding unless I submit a written notice to Travellers Insurance & Surety Corporation revoking or altering the same.
