Shillong, Jan 5 (PTI) Members of various tourist taxi associations in Meghalaya on Friday took part in a 48-hour strike in protest against the new penal law on hit-and-run cases.

Members of the Khasi Hills Tourist Taxi Association positioned themselves in several junctions along the interstate highways and stopped tourist taxis that did not take part in the protest.

Association general secretary Bhaskar Deb said the protest was in line with the Greater Guwahati Tourist Taxi Association. Tourist taxis will remain off the roads in both the states on Saturday.

Deb said the strike is not against tourists, but is aimed at protecting fellow drivers from the proposed law.

Under the Bharatiya Nyaya Sanhita, set to replace the Indian Penal Code, drivers who run away without informing authorities after being involved in serious road accidents due to negligent driving face up to 10 years in prison or a fine of Rs 7 lakh. The punishment in such cases was two years in the British-era Indian Penal Code (IPC).

JUDGMENT AND ORDER (ORAL)

Heard Mrs. S.K Nongrum, learned counsel appearing for the petitioner as well as Mr. A.H Hazarika, learned counsel appearing for respondent No. 1 - 7, 10, 11, 12 & 13, Mr. S.P Mahanta, learned counsel appearing for respondent No. 8, Mr. K. Buruah, learned counsel appearing for respondent No. 9 and Mr. S. Sen, learned counsel appearing for respondent No. 14.

2. The prayer sought for in the present writ petition is for a direction to the respondents to allot a permanent space/parking space to the petitioner-association.

3. The members of the petitioner association are plying commercial vehicles viz., Tata Sumo, Indica, as well as other diesel driven vehicles. The members of the petitioner-association were originally allotted Shillong Municipal Board parking lot adjacent to the Shillong Club (opposite to State Bank of India), Kachari Road, Shillong and they were plying their vehicles from that stand.

4. At the end of the year 2010, the members of the petitioners' association were asked to shift from that parking lot to the Polo Parking Lot. It is also stated that the petitioner-association was affiliated to Meghalaya Indica (D), Tourist Taxi Driver's Welfare Union, Meghalaya Indica (D) Tourist Taxi association and the Khasi Hills Tata Sumo Tourist Taxi Drivers Association. The members of the petitioner-association had vacated their original parking stand/parking lot adjacent to Shillong Club and parked their vehicles at the parking space i.e Polo Parking Lot. It is stated that much inconvenience had been caused to the members of the petitioner association at the time of parking their commercial vehicles at the said parking lot i.e Polo Parking Lot.

On further enquiry, the petitioner-association came to know that the parking lot at Polo had been under the control, management and supervision of Shillong Recreation Ground Trust and at no point of time, the State respondents had any interaction with the said Trust for granting permission to the members of the petitioner association to use the parking lot as their stand (Polo Parking Lot).

It is also stated that due to non-allotment of permanent stand or parking lot, the members of the petitioner association are plying their commercial vehicles from the stand of the Shillong Municipal Board near Anjalee Cinema Hall leased out to the other private associations and for using that parking lot near Anjalee Cenima Hall, the members of the petitioner association had to pay exorbitant parking fee as well as service charges to the private association to whom the said parking lot had been allotted.

Because of the non-availability of permanent parking lot or suitable parking lot, the members of the petitioner association are left to the mercy of the other private associations to whom the permanent parking lot had been granted by the respondent authorities. It is further case of the petitioner-association that under section 117 of the Motor Vehicle Act, 1988, the State Government or any authority authorized in this behalf by the State Government may, in consultation with the local authority having jurisdiction in the area concerned, determine places at which motor vehicles may stand either indefinitely or for a specified period of time, and may determine the places at which public service vehicles may stop for a longer time than it necessary for the taking up and setting down of passengers and as such, the State Govt. or any authority is duty bound to determine places at which motor vehicles may stand either indefinitely or for a specified period of time, and may determine the places at which public service vehicles may stop for a longer time than it necessary for the taking up and setting down of passengers.

Mrs. S.K Nongrum, learned counsel by referring to the pleadings of the petitioner-association in the present writ petition contended that the petitioner-association at least needs an office so as to enable the members of the petitioner association may know where the other members are plying their vehicles. This is a must for the members of the petitioner-association so that they may help each other in the event of any untoward incident.

9. Mr. A.H Hazarika, learned counsel for the respondent contended that the State respondent is not concerned with the plot required for running an office of the petitioner-association. However, this court is not expressing any opinion but the State Government shall look into this matter for the welfare of the members of the petitioner association.

10. It the further case of the petitioner-association that the State respondent had already allotted parking lot to the other private associations. It is also stated in the writ petition that the petitioner-association had filed a number of representations, some of which are at Annexures - VII and VIII to the writ petition, to the different authorities for granting or for allotting parking lot to the petitioner-association so that the members of the petitioners association may not be subjected to exorbitant parking fee as well as service charges by the private associations to whom the State respondent had allotted the parking lot and also the members of the petitioner-association may run their business of plying tourist taxis i.e Tata Sumo, Indica and other diesel driven vehicles from the parking lot allotted to the petitioner-association. It is further case of the petitioner-association that none of the representations mentioned above filed by the petitioner-association had been considered and disposed of by the respondent authorities or in other words, the said representations are still pending with the authority concerned.

In the above factual backdrop, this writ petition is disposed by directing the petitioner-association to file afresh representation more fully, mentioning their grievances and difficulties faced by them because of non-availability of parking lot for the members of the petitioner-association to the Principal Secretary/Commissioner & Secretary, Transport Department, Government of Meghalaya within a period of 2 (two) weeks and the respondent on receipt of the representation shall dispose of the same by passing a reasoned order within a period of 2 (two) months from the date of receipt of the representation and if necessary, the authority may give an opportunity of hearing to the members of the petitioner association.

12. It is made clear that any order passed by the authority concerned on the representation so filed by the petitioner-association shall be communicated to the petitioner-association very promptly. Mr. A.H Hazarika, learned counsel appearing for the State respondents contended that the petitioner-association may be directed to submit the numbers and particulars of the vehicles of the petitioner-association in the representation; and accordingly, the petitioner-association is directed to mention the numbers and particulars of vehicles in the said representation.

13. With the above directions and observations, this writ petition is disposed of.

14. It is made clear that the interim order dated 30.08.2012 passed in the present writ petition stands vacated.

SHILLONG: As the cry for raising fares of taxis and three-wheelers is becoming louder by the day, the state government has responded positively by referring the matter to the Transport department for working out the details. It is expected that the Transport department would submit its recommendations next week to enable the government to take a final call. Earlier, Joint Coordination Committee of Commercial Vehicles expressed concern over the serious financial losses suffered by the taxi operators due to the long lockdown. The committee has urged Deputy Chief Minister Prestone Tynsong to exempt commercial vehicles from paying different taxes related to local taxis and tourist taxis within the lockdown period. The committee, which comprises the East Khasi Hills Local Taxi Welfare Association, Hynniewtrep Tourist Taxi Association, Meghalaya Tourist Taxi Association and All Shillong Tourist Taxi Driver United Organisation, pointed out the plight of transport sector having had no earnings during the lockdown period. “It has become practically impossible to meet bank payments and due taxes and other cost and it has become difficult to maintain the daily needs of the families”, they said. Arbitrary hike As taxis have tentatively begun operations in Shillong after the easing of lockdown, the cabbies have arbitrarily raised the fares. Some passengers complained on Wednesday that some taxi drivers had “doubled” the rate that existed prior to lockdown for fixed-route shuttle service. One irate customer alleged that for hiring a taxi from Khyndailad to 101 Area Upper Shillong, a taxi driver extracted Rs 350 which is exorbitantly high. The taxi drivers, on the other hand, expressed concern over the application of passenger restrictions imposed due to COVID protocol. “If we cannot carry the normal passenger load, then we have to balance it by hiking the charges”, said one cabbie in defence. During the day, it was also noticed that a section of citizens, who are habitual users of taxis for local movement, preferred to walk, apparently out of fear of contacting the virus.

Taxi Service Meghalaya: Tourist cabs to go on strike on January 5 for 48 hours

Guwahati:  In continuation of the protest against the Bharatiya Nyaya Sanhita (BNS), tourist taxis in Meghalaya have announced to go on a strike for 48 hours starting on January 5.

The strike is a part of the nationwide protest against the yet-to-be-implemented BNS.

The strike will start at 5 am on Friday and will continue for 48 hours.

The protest in Meghalaya is coordinated with various other taxi and transport associations in the region.

Khasi Hills Tourist Taxi Association general secretary Bhaskar Deb said that all taxis would be off the road to protest the rule.

He said that no driver would want to drive if the government brought a law that would put them in jail for an accident.

Manna Sangma, a taxi driver said that while it is necessary for reducing accidents and also bringing justice to people in hit-and-run cases, it would not be possible to protect the drivers in such incidents.

He said that most of the time people would only blame the commercial vehicle driver when an accident happens.

“No one takes our side if by any chance we tend to meet with an accident. Since we are poor, most people would run towards us to beat us”, he said.

It may be mentioned that along with Meghalaya, commercial vehicles across the region will be on strike on January 6.

The need for the introduction of such an identification card of the passengers booking the tourist taxis is felt because some of the drivers have lost their life to carjackers and murderers who after killing them stole their vehicle. The latest case in point is that of the Swift tourist taxi driver  Samuel Mawlong who body was found in Lumshong in East Jaintia hills district as he had been killed by carjackers who stole the vehicle.

MTTA on Wednesday also decided to re-issue ‘identity cards’ to all drivers under its umbrella keeping their safety in mind.

MTTA general secretary Diganta Nath told a news conference on Wednesday, “We have sought the intervention of the state police for issuing of identity cards to all members of the association which will be duly verified by them to help prevent such crimes against drivers in the coming days.”

Saying that the tourist taxi drivers have become a soft-target for criminals and carjackers Nath said such steps to ensure the drivers safety has become important considering that last year of the three tourists taxi drivers’ bodies of two have been recovered.

Nath felt that non-verification of new and old drivers is one reason that makes the drivers vulnerable to criminals, he said, “Now, no driver will be allowed to ply without the identity card.”

On the need for identification of passengers who books the tourist taxis Nath said, “This is part of the preventive measures considering the need to identify the passenger with full identity proved who is booking the vehicle.”

Nath also felt that non-availability of proper parking stand for the tourist taxis after they were disallowed parking in Police Bazaar has led to lack of communication between the association and its members and this has made it impossible for the MTTA to keep a tap on the movement of its members and the passengers boarding the tourist taxis as the drivers are functioning independently.

The MTTA informed that around 100 – 150 tourist cabs are plying from Guwahati – Shillong every day.

The MTTA has also banned three of its drivers including Prakash Purkayastha, Sanjay Bisva and Guatum Tati who were recently arrested for their involvement in the murder of Samuel Mawlong and lifting vehicles from the region.

“The three are completely banned to ply in Meghalaya as drivers,” Nath informed even as the MTTA condemned the gruesome murder of the three drivers.

Apart from three, Chandra Prakash Sharma alias Mithu who is the ringleader of carjackers gang and Sidhar Thapha were arrested by the police in connection with several car theft and murder cases .- By Our Reporter

Meghalaya: KHNAM, Taxi associations carry out surprise checking of taxis in Shillong

After the KHADC failed to meet the demands within the two-week deadline, the three organisations on Monday conducted a checking in and Police Bazaar area to detect non-tribal drivers who does not a labour licence issued by the Council.

The organisations which included — Khun Kynniewtrep National Awakening Movement (KHNAM) State Youth Wing (SYW) Hynniewtrep Tourist Taxi Association (HTTA) and East Khasi Hills Taxi Association (EKHTA) conducted the checking on their own after the KHADC had failed to comply to their demands to carry out a surprise checking of the non-tribal drivers who does not have the labour licence. The three organisations had issued the deadline on April 16 last.

The three organisations found that there are quite a huge number of non-tribal drivers who does not labour licence from the Council even as they found out that there are drivers who does not have even a driving license.

"We have conducted the checking on our own since the Council has failed to response to our request to ask the staff from Enforcement wing to carry out the checking," KHNAM Youth president, Thomas Passah told newsmen today.

While slamming the Council for failing to take its responsibility seriously, he said that the three organisations will will continue to conduct similar checking in the coming months.

"We would be compiling the names and plate number of the vehicles of those non-tribal drivers who do not possess the labour licence. We will then submit this to the KHADC CEM PN Syiem," Passah said adding that they might even file a case against these non-tribal drivers who have been conducting their business without proper licence as this is against the rules and regulations of the council laws," he said.

He added, "Some of the non-tribal drivers does not even know that they need a work permit or labour licence to carry out their buisness and hence this points to the lack of awareness on this issue," he said.

Passah further said its understandable that many of the local youths in the state are unemployed because most of the business are being overrun by non-tribals who does not have proper working permit or labour licence.
