While providing a promising avenue through which skilled foreign nationals can come work in the United States, the H-1B program is plagued with issues, making the US a less viable option for foreign workers. The time limitation on H-1B visas, for example, is a frequent problem; these types of visas can be granted for three years and then can be extended for three additional years, after which point the foreign national must remain outside of the U.S. for at least one full year.

Given these and other problems frequently encountered with H-1B visas, many foreign nationals turn their sights to Canada in terms of their next employment opportunity. 

Canada offers several options with respect to work authorization that either have similar eligibility criteria to the H1-B visas, or that present the possibility of the foreign national continuing their career in North America.

These options are summarised as follows:

Global Talent Stream : This is a facilitated work permit option that targets foreign nationals working in the IT sector. Many of the occupations eligible for this work permit constitute “specialty occupation” as defined in the H-1B program, making the transition to a Canadian work permit easier;

Intra-Company Transfer : Many of the foreign national on H-1B visas work for multinational companies that have a presence in Canada. Certain categories of workers on H-1B visas can be eligible for a facilitated Canadian work permit through an Intra-Company Transfer;

Intra-Company Transfer Start Up : Foreign nationals working for U.S. companies looking to establish a presence in Canada can be eligible for facilitated work permits that will allow them to work in Canada in order to begin operations of a Canadian branch, subsidiary, or affiliate;

CUSMA (Formerly NAFTA)

CUSMA : Mexican citizens on an H-1B visa in Canada can be eligible for a facilitated work permit through the Canada-US-Mexico Agreement if they are qualified to work in a given occupation and are coming to working Canada in this capacity. A complete list of eligible occupations can be found here ;

Business Visitors : H-1B visa holders needing to come to Canada for work-related reasons can qualify as business visitors in certain scenarios and are therefore exempt from the requirement for a work permit.

Canada is launching a work permit for U.S. H-1B holders. Here's what you need to know

As of Sunday, the federal government has opened up applications for a new work permit for foreign workers living in the U.S. to move to Canada.

Foreign nationals living in the U.S. with an H-1B visa can now apply to work and live in Canada as the federal government begins to roll out measures of its new strategy to attract tech workers.

The H-1B specialty occupation visa holder work permit was announced in June along with updates to various workers permits , including the creation of an express entry program for workers employed or trained to work in the STEM (science, technology, engineering and math) sectors.

With the application process officially opened, here’s what applicants need to know.

WHO CAN APPLY?

The H-1B visa program is specifically for highly educated individuals working in or trained to work in a specialty occupation. These jobs often require additional education like a bachelor's degree or certification or licence required to work in that specialty occupation.

Holders of this visa can live and work in the U.S. for three years and a max of up to six years on exception, as well as their spouses or unmarried children under the age of 21.

While, Canada’s new program for U.S. H-1B visa holders was announced in part of the federal government’s aggressive plan to attract workers in the technology sector, the program is open to any holder of a U.S. H-1B visa despite their job field.

Previous jobs approved by the U.S. Citizenship and Immigration Services have included software engineers, graphic designers, electrical engineers as well as physicians, teachers, and therapists.

Successful applicants of the program will be able to get an open work permit to live and work in Canada for up to three years. The Canadian work permit won’t be revoked if the permit holder gets laid off or quits their job, unlike the U.S. H-1B, which requires workers to find a new job within 60 days or leave the country.

However there is no possibility for extension, although permit holders can try and apply through another program after the three-year period.

Similar to the U.S. H-1B visa, the Canadian pathway will also allow the spouses, common-law partner and/or children of a temporary worker to live and work in Canada for the granted time period.

HOW CAN I APPLY?

Interested applicants can apply through the Immigration, Refugees and Citizenship Canada (IRCC) page portal by submitting the following documents; a copy of their current H-1B visa, a Notice of Action form that confirms when the U.S. government approved their workers permit and proof of U.S. residency.

The application also costs C$155 and successful applicants will be notified in approximately six weeks if they have been approved.

Once approved, the IRCC says a “port of entry letter of introduction” will be sent to the applicant detailing how long they can work in Canada and under what conditions.

Immigration Minister Sean Fraser says there are currently 400,000 H-1B visa holders in the U.S. but the temporary policy will only accepts applicants for one year or until 10,000 applications are received, whichever comes first.

We refer to your fingerprints and photo as biometrics. We collect biometrics for most applications. Find out what happens from when you submit your application to when you get to Canada and where biometrics fits in the process.

1. Apply for your visitor visa, study permit or work permit

If you want to visit, study or work in Canada, make sure you’re eligible to apply. Use our application guides to help fill out your application properly, then submit your application.

Avoid processing delays by sending us a complete application .

2. Get your fingerprints and photo taken

If you’re between 14 and 79 years old, you probably need to give your fingerprints and photo (biometrics).You only need to give your biometrics once every 10 years to make repeat trips to Canada easier.

  • You must pay the  biometrics fee   when you submit your application.  Otherwise you may experience delays.
  • Get this done  as soon as you get the letter  from us that tells you to give biometrics.
  • You have  30 days  to do this from the date on the letter.

COVID-19: Biometrics deadline

Some biometrics collection sites are closed. If the site closest to you is closed, we’ll extend your deadline to give your biometrics. Find out how COVID-19 is affecting biometrics .

3. We process your application

After we get your biometrics, we start processing your application. See how long it takes to process your application.

If we need more information from you, we’ll contact you.

4. We make a decision on your application

When we finish reviewing your application, we let you know if you’re approved to come to Canada. If you are, we issue your documents.

If your application is refused, we send you a letter that tells you why.

5. You travel to Canada (if you’re approved)

Make sure you travel with the documents we gave you. This includes travel documents like a visitor visa, study or work permits or an eTA (electronically linked to your passport).

Airline staff and border service officers at ports of entry will ask to see your travel documents. If you don’t have them, you may not be able to board your flight to Canada.

Make sure children under 18 travel with the right documents .

6. We check your identity when you arrive in Canada

When you arrive, we check your identity to make sure that you are the same person who was approved to travel to Canada. We may use your biometrics to do this.

If we can’t verify your identity, you may be detained by a border services officer. These officers help protect the health and safety of Canadians.

If the officer determines that you’re not admissible to Canada, you won’t be allowed to enter Canada. If you came by air, you’ll have to take a return flight to where you came from.

7. You’re allowed to enter Canada

If you pass the identity check and meet the entry requirements , the border services officer stamps your passport and lets you know how long you can stay in Canada. You’re normally allowed to stay in Canada for up to six months.

Children under 18 must meet the same entry requirements as adults. The border services officer may ask minor children to show other documents depending on whether the child is travelling alone or with someone.

You must meet some basic requirements to enter Canada. You must:

  • have a valid travel document, like a passport
  • be in good health
  • have no criminal or immigration-related convictions
  • convince an immigration officer that you have ties—such as a job, home, financial assets or family—that will take you back to your home country

  • Groups of 3 or more performing artists and their staff  who apply for work permits at the same time: maximum total fee of $CAD 255

Permanent residents of Canada

We do not issue temporary resident visas (TRV) to permanent residents (PR). If you are outside Canada without a valid PR card, you must apply for a permanent resident travel document (PRTD) instead. If you meet the requirements for a PRTD, you can return to Canada as a PR.

If you no longer want to be a PR, or if you know you do not meet the requirements to keep your PR status, you can voluntarily give up (renounce) your PR status to apply for a TRV.

You can’t fill out and save the application form using your Internet browser. To use the form, you need to:

  • Use your computer (Mac or PC). The form won’t open on mobile devices (iPads, tablets, mobile phones, etc.)
  • Install Adobe Reader 10 (or higher)
  • Download the PDF file to your computer . Save the file in a place you can remember.
  • Make sure you use Adobe Reader to open the form. Sometimes if you try to open the form directly, it will use your Internet browser to try to open it.

As of today, those who hold a United States H-1B specialty occupation visa may be eligible to apply to work and live in Canada.

The measure was announced by Canada’s Immigration Minister, Sean Fraser, on June 27 and aims to improve labour mobility in North America. It may impact thousands of workers in high-tech industries in both Canada and the United States, as well as their immediate family members.

Those who are approved will receive an open work permit valid for up to three years. An open work permit means that they can work for almost any employer in Canada. This also applies to their spouses and dependents who can apply for work or study permits as needed.

Immigration, Refugees and Citizenship Canada (IRCC) says the measure will last for either one year or until the cap of 10,000 applicants has been reached. This cap is on principal applicants and does not include family members.

Eligibility criteria for Canada's H-1B visa holder open work permit

To be eligible for Canada's H-1B visa holder open work permit, you need to:

  • have a valid H-1B specialty occupation visa, and

IRCC targeting STEM occupations

On June 28, IRCC announced that it would hold the first Express Entry draw for those with work experience in Science, Technology, Mathematics and Engineering (STEM) occupations . The draw is part of the category-based selection criteria announced by the Minister on May 31.

The department followed through on July 5 and invited 500 candidates with work experience in STEM, many of which may also be eligible for the new H-1B open work permit. Those who were invited were already in the Express Entry application pool.

There are five new Express Entry categories for those with work experience in specific occupational fields. The sixth category is for those with strong French language ability. The categories were chosen following research and discussion with IRCC partners and stakeholders as well as provincial and territorial governments who are likely to be more in tune with local labour shortages.

IRCC said inviting candidates through the Express Entry STEM category was a milestone in Canada’s commitment to attracting top global talent and remaining at the forefront of global research, development, and innovation.

For example, in Budget 2023 , Canada’s government announced that would invest $20 billion to support the building of major clean electricity and growth infrastructure projects. Much of this development will require the skills and knowledge of STEM professionals.

Canada’s tech talent attraction strategy

In addition to the 3-year open work permit for H-1B holders, IRCC is also working on developing a new Innovation Stream under the International Mobility Program (IMP). Minister Fraser said the Innovation Stream will be launched by the end of this year.

The options for the stream are being developed and informed by the feedback of stakeholders received through several consultations in recent months.

There are two options under consideration

  • Employer-specific work permits for up to five years for workers destined to work for a company identified by the Government of Canada as contributing to our industrial innovation goal
  • Open work permits for up to five years for highly skilled workers in select in-demand occupations

Further, the minister announced a return to the 14-day service standard for work permits under the Global Skills Strategy , the promotion of Canada as a destination for digital nomads and improvements to the Start-up Visa Program such as more spots allocated and extending the length of the work permit from one to three years.

STEM job vacancies in Canada

The latest job vacancy data from Statistics Canada shows that there were 42,900 job vacancies in professional, scientific, and technical services in April, down by 7,700 (-15.2%) from March, and by 30,600 (-41.6%) from its peak of 73,600 in April 2022.

Ontario and Quebec continue to have the highest number of vacancies in the country. To help fill these vacancies, especially in the STEM sector, Ontario recently removed the Canadian work experience requirement for newcomers seeking licensure in engineering.

On June 30, Ontario's Ministry of Labour, Immigration, Training and Skills Development also announced that regulated professions in Ontario will be required to make and communicate registration decisions on applications from internationally trained newcomers within six months. Travel on H-1B Visa

Travel during the visa request process.

Always discuss your travel plans with the International Scholars Operations (ISO) team before traveling internationally and before any petition is filed with U.S. Citizenship and Immigration Services (USCIS) on your behalf.

Changes of Status

If you are in the U.S. and attempting to change your status to H-1B, or if your dependents are applying for a change of status to H-4, do not travel outside the U.S. while the petition is pending with USCIS. USCIS may say that you have abandoned the petition and deny your change of status. In this situation, you would have to exit the U.S., apply for a new H-1B visa stamp, and reenter as outlined in Coming to the U.S. page .

Extensions of Status and Changes of Employer

You can travel internationally and reenter the U.S. while your H-1B status is being extended or transferred from one employer to another, provided you have a valid I-797 Approval Notice and a valid H-1B visa (unless visa-exempt or eligible for automatic visa revalidation). If your current H-1B expires before you return, you may have to wait until the H-1B extension is approved to reenter.

Returning to the U.S. after a Temporary Absence

When returning to the U.S. after a temporary absence, be prepared to show the following to the Customs and Border Protection officer:

  • Original and unexpired Form I-797 Approval Notice.
  • Passport valid for at least 6 months beyond the end date of your expected stay.
  • Letter from your UW host department confirming you are returning to continue full-time employment in the job described in the I-129 petition.
  • These were forwarded to you by your host department. If you cannot locate them, contact ISO .
  • Note: If the visa has expired, it may be extended by presenting the documents listed above to a U.S. consulate . Anticipate delays due to security reviews. For information about the visa process and to schedule an interview appointment, contact the U.S. consulate in the city where the application will be submitted.

Short Travel to Canada or Mexico under Automatic Visa Revalidation

A valid H-1B visa stamp (or H-4 visa stamp) is not required for reentry to the U.S. following a visit of less than 30 days in Canada or Mexico, as long as you have a valid H-1B approval notice. This is called automatic visa revalidation. However, if you apply for a new visa while in Canada or Mexico, you will not be able to return to the U.S. unless the visa is granted.

Automatic visa revalidation is not available to nationals of countries on the State Sponsors of Terrorism list .

In general, re-entering the United States from Canada and Mexico require the same documents and procedures as travel from any other country. However, under very specific and limited conditions, H-1Bs may travel to Canada or Mexico and re-enter with an  expired  H-1B visa under “automatic visa revalidation.”

Use  extreme caution  if traveling under this option, and consult an advisor at ISSS before making travel plans! 

Automatic Visa Revalidation (AVR) allows certain individuals to re-enter the United States from Canada or Mexico with an expired visa as long as they continue to meet all requirements for their visa type. Under AVR the visa is considered to be "extended" to the date of re-entry, eliminating the need to obtain a new visa for that particular entry.

ALL of the following conditions must be met to be eligible for Automatic Visa Revalidation: 

  • Your trip must be to Canada or Mexico ONLY. Travel to any other country before returning to the U.S. will make you ineligible for AVR.
  • Your stay in Canada or Mexico must be for 30 days or less.
  • You must have a valid, unexpired passport.
  • You must have a valid, unexpired I-797 Approval Notice.
  • You must have a print out of your current I-94 (available at  https://i94.cbp.dhs.gov/I94/#/home ).
  • You must have an expired H-1B visa in your passport.
  • You CANNOT apply for a new visa at a U.S. Embassy or Consulate while in Canada or Mexico. If you apply for a new visa you cannot enter the U.S. until the new visa is approved.
  • You must have maintained and intend to resume non-immigrant H-1B status.
  • You are only eligible if you have never had a visa canceled under INA § 222(g)
  • You must not be inadmissible as a nonimmigrant under INA § 212. 
  • Citizens from Cuba, Iran, North Korea, Sudan and Syria are not eligible.  

Allow extra time at the Port of Entry (airport or land border) for immigration inspection, and double check any stamps or notations in your passport before you leave the inspection area. If you feel there is an error or problem, ask the inspection officer to clarify.

After Re-Entry:

  • Retrieve and print/save your I-94  at  https://i94.cbp.dhs.gov/I94/#/home . Verify that the information on the I-94 is correct and that the “Admit until Date” is the same as your H-1B authorized end date or within 10 days after. If the date is any earlier, notify ISSS immediately.
  • Check entry stamps and I-94s for all H-4 dependents.
  • Make an appointment at ISSS to return the original I-797.  Bring your passport, I-797 and I-94 (and dependent’s documents) with you to the appointment.

U.S. companies and H-1B visa holders can benefit from new rules Canada has announced to attract high-skilled professionals. The new policies show the Canadian government wants more foreign-born scientists and engineers in its country—following the advice of economists on the benefits of high-skilled immigration. At the same time, the Canadian announcement makes U.S. lawmakers who support the status quo or more restrictions on business immigration appear out of step as other nations seek to attract talent.

10,000 Open Work Permits For H-1B Visa Holders

On June 27, 2023, Minister of Immigration, Refugees and Citizenship Sean Fraser announced Canada’s “ Tech Talent Strategy ,” focused on liberalizing immigration rules for foreign workers in the United States. He made the announcement at Collision 2023 in Toronto.

The most significant part of Minister Fraser’s announcement involved H-1B visa holders working in the United States. Canada has no annual limit on high-skilled temporary visas and no per-country limits for permanent residence. In contrast, the vast majority of H-1B registrations in the U.S. are refused due to the H-1B annual limit of 85,000 for companies. Employment-based green card applicants from India can wait potentially decades due to the per-country limit in U.S. immigration law.

“As of July 16, 2023, H-1B specialty occupation visa holders in the US, and their accompanying immediate family members, will be eligible to apply to come to Canada,” according to a Canadian government Backgrounder . “Approved applicants will receive an open work permit of up to three years in duration, which means they will be able to work for almost any employer anywhere in Canada.”

In the United States, generally, only the spouses of H-1B visa holders with pending green card applications are eligible for employment authorization, not all spouses of H-1B professionals. In Canada, the spouses and working-age dependents of foreign workers typically receive work authorization. The Canadian government announcement states that spouses and dependents of H-1B professionals who come to Canada under this policy will be allowed to work.

The new program has a numerical limit. “This measure will remain in effect for one year, or until IRCC [Immigration, Refugees and Citizenship Canada] receives 10,000 applications,” according to the government. Only principal applicants will count against the 10,000 limit. In the past, several Canadian pilot programs have become permanent.

Who Is Likely To Benefit From The Policy?

Peter Rekai, senior partner of Rekai LLP in Toronto, believes most people who come to Canada under the new policy will already have arranged employment, given the costs of moving to a new country and renting a city apartment. However, receiving an open work permit will make it easier to find a job since employers can forego the initial immigration paperwork and other approvals.

Three categories of H-1B visa holders are most likely to benefit from the new Canadian policy. First, individuals experiencing layoffs in the United States and unable to land a new job within 60 days could find going to Canada on an open work permit and seeking employment preferable to returning to their home country.

Second, H-1B professionals waiting in employment-based immigrant backlogs may decide waiting one or more decades for permanent residence is too long. The long wait would be due to the per-country limit and the low annual number of employment-based immigrant visas. Such individuals would almost certainly wish to arrange employment with a Canadian company before leaving their job in the United States.

Third, H-1B visa holders denied an extension might benefit from Canada’s policy. During the Trump administration, denial rates of H-1B petitions for continuing employment reached 12% in FY 2018 and FY 2019. After a USCIS legal settlement following successful litigation by an employer group (ITServe Alliance), the denial rate for continuing employment dropped to 2% by FY 2022. H-1B visa holders with immigration problems will likely explore Canada’s new policies.

These are preliminary assessments of the Canadian announcement. More details from the government will clarify the scope of the new proposals.

How The New Canadian Rules Can Help U.S. Companies

The Canadian government has appreciated the benefits of attracting foreign investment is good for an economy, recognizing that talent and investment go together.

“Canada has already been encouraging skilled foreign workers to move there for several years, with welcoming immigration policies and even a cheeky billboard campaign in the heart of Silicon Valley three years ago,” reports Carolyn Said in the San Francisco Chronicle . “Its efforts have paid off. Toronto is now the third biggest hub for tech employment in North America, after the Bay Area and New York, according to CBRE’s annual ranking .”

Many of America’s leading technology companies have large or growing offices in Canada, with U.S. immigration policies a significant driver of moving resources from the United States. “Thousands of workers in high-tech fields are employed with companies that have large operations in both Canada and the U.S., and those working in the U.S. often hold an H-1B specialty occupation visa,” according to the Canadian government’s Backgrounder .

Members of Congress who believe imposing restrictions on H-1B visas leads to more jobs for U.S. workers have been shown to be mistaken . “Firms respond to restrictions on H-1B immigration by increasing foreign affiliate employment at the intensive and extensive margins, particularly in China, India and Canada,” according to widely-cited research by Britta Glennon, an assistant professor at the Wharton School of Business at the University of Pennsylvania.

Rekai recommends U.S. companies with operations in Canada use the new policy as a way to “hang onto” employees they would otherwise lose due to U.S. immigration issues. That would include employees with a denied extension or dissatisfied with the pace of moving toward permanent residence due to backlogs or administrative problems.

Canada's effort to lure H-1B visa holders is just one of several programs to facilitate the admission of information technology professionals, including streamlining or eliminating labor market assessments, he notes.

The Canadian government announced it “will create a new exemption from the labour market impact assessment process to help high-growth employers and talented workers in support of Canada’s innovation priorities and high-tech industries.”

Employers in Canada can now avoid the requirement to test the labor market in certain categories by presenting approved training and recruitment plans (called Labour Market Benefits Plans ). Minister Frasier would ease those requirements further by the end of the year.

“The feedback from stakeholders on the Innovation Stream proposal has led IRCC [Immigration, Refugees and Citizenship Canada] to consider two options that are not mutually exclusive: 1) employer-specific work permits for up to five years for workers destined to work for a company identified by the Government of Canada as contributing to our industrial innovation goals; 2) open work permits for up to five years for highly skilled workers in select in-demand occupations,” according to the government Backgrounder.

The Canadian government also announced improvements to its startup visa program. Those changes could increase the intake in those programs, but attorneys note given the ease of Canada’s pathway for high-skilled workers, it is often quicker to use the employment route or to start a company in another nation and transfer yourself to a new Canadian office. A startup visa program is more likely to benefit foreign nationals in the United States because of the longer and more uncertain U.S. path to permanent residence and the attractive size of the American market. U.S. attorney Tahmina Watson has published a new book offering practical immigration advice for foreign nationals seeking to found a company in the United States.

Dissatisfaction With The U.S. Immigration System

Many employers and foreign-born scientists and engineers are dissatisfied with the U.S. immigration system. During negotiations over the CHIPS Act in 2022, Sen. Charles Grassley (R-IA) blocked from becoming law an exemption from yearly green card limits for foreign nationals with a Ph.D. in STEM (science, technology, engineering and math) fields and those with a master’s degree “in a critical industry.” Given the long waits for employment-based green cards and the difficulty in obtaining H-1B temporary status in the United States, it’s not surprising the number of Indians immigrating to Canada has more than tripled since 2013.

Foreign nationals in the United States laid off or dissatisfied with long waits for employment-based green cards may find increased opportunities in Canada. New Canadian rules will allow U.S. companies more options to retain H-1B visa holders denied an extension or otherwise unable to remain in the United States. The Canadian announcement may make U.S. lawmakers who have opposed more liberalized immigration policies appear out of touch compared to government officials in other countries competing for talent in the global economy.

When you travel outside of the U.S., you should take the following with you:

  • A copy of the H-1B petition/Form I-129 as it was submitted to USCIS
  • The original I-797 approval notice
  • Your valid passport
  • Proof that you are maintaining H-1B status (3 recent paystubs)
  • You can also request a “Travel Letter” from our office.  This is not required , it is a courtesy that OIS provides.

To request a Travel Letter:

  • Go to iHopkins Self-Service Portal: http://ihopkins.jhu.edu/
  • Use iHopkins login  option #1: ACTIVE JHED LOGIN.  Enter your JHED ID (network/login ID) and password
  • Click “ University Employment ” from left side menu
  • Click “ Travel Letter Request ” to open the eForm
  • Complete and submit the eForm

You are required to have a valid H-1B visa in your passport to return to the U.S. from all countries except for brief trips (less than 30 days) to Canada & Mexico ( see below ). Before applying for the H-1B visa at a U.S. Consulate/Embassy abroad, please review the U.S. Consulate/Embassy  website  where you will apply for the visa to see if they require documents in addition to those listed above.  Please note that Canadian citizens are exempt from the visa stamp requirement.

You are permitted to travel to Canada and Mexico for less than 30 days without a H-1B visa stamp in your passport (you still need to take the other documents mentioned above). For detailed information about automatic visa revalidation, please refer to the information provided on  Department of State’s website  .

Important Steps to take when you return to the U.S. from travel abroad :

  • If you have an electronic I-94, retrieve and print your I-94. To access your record you will need your passport. Go to https://i94.cbp.dhs.gov/I94/#/home
  • Your name  should appear as it is stated in your passport
  • The appropriate  visa classification (H-1B or H-4)
  • The  end date  on the I-94 should match the H-1B approval notice (Form I-797) or be extended for 10 additional days beyond the end date of the H-1B approval notice
  • If your I-94 is shortened due to your passport expiring prior to the I-797, your status will end on the date marked on the I-94 record rather than the H-1B approval notice
  • Contact the OIS if you notice an error or data inconsistency, or if the end date on the I-94 does not match your H-1B approval notice (or the H1B approval end date + 10 days)
  • Upon return from travel, document your time abroad on the Recapture Worksheet. The worksheet will make extensions beyond six years less cumbersome, and help ensure all available H-1B time can be requested from USCIS

H-1B Travel

Initial entry to the u.s. in h-1b status, required documents.

  • Valid passport with validity for at least six months following authorized period of stay  
  • Valid H-1B visa stamp (unless visa exempt, i.e. Canadian citizen)  
  • Form I-797 Notice of Approval of H-1B status

Upon admission to the U.S., you will need your I-94 record of arrival.

  • If entering by land, you will need an I-94 card. The Customs and Border Protection (CBP) officer at the U.S. port of entry will issue an I-94 card to the foreign national. For H-1B and H-4 foreign nationals, the CBP officer should indicate an expiration date on the I-94 card. The expiration date refers to the length of time an H-1B foreign national has permission to remain temporarily in the United States. CBP may include a 10-day grace period following the period of approved H-1B status.

We strongly recommend that you print and save your I-94 record after entrance into the United States.

Travel During Period of H-1B Status

In order for H-1B aliens to request permission to re-enter the U.S. after a temporary departure, they must present the following documents at the port of entry:

  • Valid passport (valid for at least six months following authorized period of stay)  
  • Valid U.S. H-1B visa stamp in passport (unless visa exempt, such as a Canadian citizen)  
  • Original, valid Form I-797 Notice of Approval of H-1B employment  
  • Evidence of current H-1B employment, including most recent pay statements and/or a letter from Human Resources verifying employment. This is not required, but recommended.

If your H-1B visa stamp is expired, or you have never held an H-1B stamp in your passport, you must apply for and receive a new stamp before returning to the United States. OVIS recommends that you check with the relevant consulate or embassy in your home country for specific information on the visa application process, as well as fees and appointment wait times.

Automatic Revalidation

After initial entry to the U.S., nonimmigrants who have an expired visa in their passport may re-enter the U.S. without obtaining a new visa if their travel was solely to the contiguous countries of Canada and Mexico.  F and J visa holders may also be able to benefit from Automatic Revalidation after travel to the Caribbean Islands (excluding Cuba).  Travel must be for a period of fewer than 30 days. This procedure is known as Automatic Revalidation of the U.S. visa.

To take advantage of Automatic Revalidation, travelers must have, in addition to the documents for re-entry stated above, a copy of their electronic I-94 record (or white I-94 card, if you have one).

  • If you are a citizen of Cuba, Iran, Sudan, or Syria, you are not eligible for automatic revalidation of your expired non-immigrant visa.
  • If you have applied for a new visa while out of the country, you may not re-enter the U.S. until the new visa is issued, even if your old visa is still valid.
  • Is in possession of an F student visa or J exchange visitor visa and has traveled to Cuba
  • Depending on your country of citizenship, you may be required to have an entry visa for Canada, Mexico or any of the other Caribbean nations in order to enter those countries. Your U.S. visa does not automatically grant entry into these other contiguous countries.

Visa Revival: Brazil to Reinstate Visa Requirements for US, Canada, Australia in 2025

F rom the sultry rhythms of samba to the pristine white sands of its beaches, Brazil has long been a coveted destination for global travelers. However, jet-setters from the United States, Canada, and Australia will need to navigate a new layer of bureaucracy before they can bask in the South American sun starting from 2025. After a brief hiatus, Brazil is reintroducing visa requirements for visitors from these countries, marking a significant shift in its travel policy.

From April 10, 2025, a holiday in Brazil will come with an additional task on the to-do list for these travelers: applying for a visa. As per the recent announcement, tourists from these nations will be expected to provide comprehensive documentation, including bank statements, to secure their entry into the country. The cost of the visa is set at $80.90, a fee that paves the way for a decade-long, multi-entry visa, but limits stays to 90 days per year.

This development is not an entirely new concept for seasoned travelers. The United States, Canada, and Australia were once subject to a Brazilian visa regime until 2019 had needed visas. E-visas were introduced for just one year before the entire system was completely abolished, but now, Brazilian authorities have decided to reinstate these rules.

According to reports, those looking to travel will need to provide their last three checking or savings account statements or their previous six pay stubs, showcasing an average balance of at least $2,000. For those who don’t meet the financial requirements, a sponsored route is available, where a guarantor can vouch financially for the traveler.

The Brazilian government’s website further stipulates the need for a letter of intent, intent should detail the dates and purpose of the trip, as well as confirmed details of where you’ll be staying. Proof of residence in the US, and return tickets to Brazil (or, if not, a signed return declaration), and proof of income will also be required.

The processing time for these visas is expected to be an average of five working days, but a prudent approach would see applicants starting the process at least two months in advance of their travel date. This window is suggested to avoid any complications or delays that could disrupt travel plans.

Brazil’s decision arrives amidst a global trend of tightening travel requirements. Like the European Union’s ETIAS program, Brazil is taking measures to regulate visitor entry more closely. While the EU’s program involves an $8 fee and targets a broader scope of countries, both systems underscore a growing emphasis on security and documentation in international travel.

Travelers planning to jet off to the vibrant cities and lush landscapes of Brazil will need to mark their calendars and prepare their paperwork. For now, those looking to samba through the streets of Rio or explore the Amazon will have to add one more step to their journey—a step that is a small price for the rich experiences that Brazil has to offer.

Inside Canada – Not eligible: Apply online under a public policy

Normally, visitors can’t apply for work permits from inside Canada. Due to a temporary policy change, visitors can apply online for an  employer-specific work permit  by following the steps below.

Who’s eligible

  • You must stay in Canada while we process your application. If you leave while your application is being processed, you won’t be eligible under this public policy.
  • Applications submitted before or after these dates are not eligible.
  • If your visitor status has expired, you’ll need to restore your visitor status before you apply for a work permit.

If you’re a visitor in Canada, you’re not eligible to apply for work permit with a labour market impact assessment (LMIA) to work as a caregiver in either of the following National Occupational Classifications (NOC):

If the printed expiry date has passed and you’re applying for a visitor visa, study permit, work permit or to extend your stay as a temporary resident in Canada, follow these steps:

  • Add 5 years to the printed expiry date shown on your passport and enter it in the expiry date field of the application form.
  • Include a letter of explanation with your application stating: “I am a Venezuelan national with a Venezuelan passport, which has been extended for 5 years”.

Warning: If your passport is still expired after adding 5 years to the printed expiry date, your passport is considered expired. You’re not eligible to submit an application with that passport.

Credit cards and prepaid cards

We accept credit cards and prepaid cards from:

  • MasterCard ®
  • American Express ®
  • UnionPay ®  (for online applications only; debit cards not accepted)

If you use a prepaid credit card, keep it for  at least  18 months after you pay to make refunds easier.  Find more on prepaid cards .

We also accept all Visa Debit cards.The card you use doesn't have to be in your name. The cardholder’s name will appear on the receipt but it does not need to match your application.

Debit cards

  • be from a Canadian bank using  INTERAC ®  Online , and
  • be registered for online banking through your bank’s website.

We also accept all Debit MasterCard ®  and Visa ®  Debit cards. If your card has the Visa Debit logo on it, alone or with the INTERAC ®  Online logo, select Visa Debit as your payment method.

The card you use does not have to be in your name. The cardholder’s name will appear on the receipt but it does not need to match your application.
