Electronic Visit Verification

Electronic Visit Verifications, or EVVs, help us to collect data mandated by federal law. The 21st Century Cures Act requires us to record a verification of some of the services that we provide. All agencies that provide these types of services are required to collect this data, which is then sent on to the state of Indiana.

CVL provides several services that are effected by this mandate.  Specifically, these are Residential Habilitation (RH 10 and RH 20 only), Personal Assistance and Care (PAC), Attendant care and Respite services.  MID, the provider of the inFocus/inCare electronic note system that CVL uses, has developed an easy to use solution to meet the EVV requirements.  The solution includes a mobile application that allows you to check in and check out of your shift as well as automatically collecting the required location information.  By January 1, 2021 all the services effected by the EVV requirement must have EVV data for every shift provided.  Absent the appropriate data, these shifts are subject to rejection when billed to Medicaid.  This requirement is state-wide and effects all agencies providing these services in Indiana. 

An EVV collects three pieces of information: the time you begin your service, the time you end your service, and the location of your service. All of this is recorded through an application on your phone or tablet.

InCare Mobile Application -  Completing an Electronic Visit Verification

Frequently Asked Questions   Can multiple providers use the same device to access InCare Mobile?

  • Yes. Multiple users can use the same app on any device, as long as they sign into their own personal account before clocking in or out.

                        Can I add a new shift to the schedule through the InCare Mobile app?

  •  No. At this time, you must still schedule shifts through the online InFocus system. You may only view any shifts that are already scheduled through the “Schedule” tab on the app.

  Why aren't my shifts showing up on the InCare Mobile app?

  • Your shifts must be scheduled in InFocus  before  they begin in order to use the InCare Mobile app. If you do not see any shifts listed on the app, check to make sure that they are scheduled in InFocus. If you still cannot see them, check to make sure that you are on the correct date. Contact your supervisor for any further assistance.

  Can I receive notifications from the InCare Mobile app?

  • No. At this time, the “Notifications” tab is not functional within the app but will be in the future.

  Can I send or receive messages through the InCare Mobile app?

  • No. At this time, the app does not allow users to send or receive messages from other users or supervisors. This function may be added in the future.

  How do I find my username and password for the InCare Mobile app?

  • Your username and password for the app are the same that you use to login to other CVL portals, such as Inspiravance and InFocus. If you do not have the correct username or password, contact your supervisor for assistance.

  Why won’t the InCare Mobile app run on my device?

  • To run the app, Apple devices must have IOS version 12.0 or higher and Android devices must have Android version 7.0 or higher. If your device is updated and still won’t run the app, contact your supervisor for further assistance.

  What types of services require an EVV clock in and clock out?

  • Residential Habilitation (RH 10 and RH 20  only )
  • Personal Assistance and Care (PAC)
  • Attendant care
  • Respite services

  What if I start a shift more than 15 minutes before the scheduled start time?

  • The InCare Mobile app will not let you clock in for a shift more than 15 minutes before the scheduled start time. If you do actually start the shift earlier than that, still clock in on the app once you are able to. When entering your note into InFocus, request a time modification to reflect the time you actually began the shift.

  What if I forget to clock in until after the scheduled end time?

  • If you have not clocked in before the shift is scheduled to end, the InCare Mobile app will not let you clock in or out. When entering your note into InFocus, request a time modification and enter in your appropriate start and end times.

  Can I change my password for the InCare Mobile app?

  • Your password for the InCare Mobile app is the same as your password for the online InFocus system. If you would like to change it, log on to InFocus and click the profile icon in the upper right corner. Select “Modify Profile” and then “Change Password.” Your new password will now work for InFocus and the InCare Mobile app.

  Is my location always being tracked by the InCare Mobile app?

  • No. The app will only access your phone’s GPS services at two different times – when you clock in and when you clock out. Your location will not be tracked by the app during your shift or when you are not working.

  What should I do if I begin or end my shift away from the individual’s home?

  • This can happen for many different reasons, most commonly if you pick an individual up or drop them off at another location. If this occurs, still clock in and out as usual. When entering your note into InFocus, you will simply make a note of the reason why in the “location exception” box. A location exception does not mean that your note will not be approved.

  If I am at the correct location, why is my location shown somewhere else?

  • GPS technology is not perfect, and sometimes it may not read your precise location. If your location is shown within a one-mile radius, you may still clock in and out as usual without any exception. If your location is shown outside of a one-mile radius, but you are in the correct location, clock in or out as usual and explain the situation in the “location exception” box in InFocus. You may also contact the EVV Help Team to ensure that the individual’s correct location is stored in InFocus.

EVV Compliance Status for Personal Care Services by State or Territory

This table lists each state or territory’s compliance status with Electronic Visit Verification (EVV) requirements as of January 1, 2021 for personal care services. States and territories were required to self-report their EVV implementation status using a web-based survey, which the Centers for Medicare & Medicaid Services (CMS) used to determine compliance with the EVV requirements included in Section 12006(a) of the 21st Century Cures Act. The table indicates whether each state or territory reported it was fully compliant, partially compliant, or not compliant with EVV requirements as of January 1, 2021. The table also includes the date the state or territory reported it had achieved full compliance, if applicable, and links to download copies of the compliance determination letters that CMS issued to each state or territory.

What is evv.

In a nutshell, EVV requires that home care caregivers login "electronically" to prove the time and location of their home care visit. For home care agencies that provide home care services reimbursed by the government (e.g., Medicaid) EVV is required by law.

What is required to comply with EVV?

The requirements for EVV are part of a law called the 21st Century Cures Act. A compliant EVV system must capture the following. 

  • The client receiving the service
  • The type of service (e.g., Personal Care Service with code T1019)
  • What caregiver provided the service. This information is used to make sure that no caregiver is working on multiple visits at the same time.
  • The exact start time and end time.
  • The location (usually captured via GPS but there are other methods).

Why are the EVV requirements different in each state?

The two biggest public health insurance programs in the US are Medicare (which provides health insurance ror elderly and disabled individuals) and Medicaid (which provides health and social care services to the poor.  Both of these programs are overseen by the US government's Committee for Medicare and Medicaid Services (CMS).

While Medicare is a national program that is administered at the federal level. Medicaid is administered at the state level, giving each state the ability to tailor its services to the needs of its citizens. This is why it's important to know the specific rules and implementation approach chosen by the state. 

How should I choose an EVV Vendor?

As important as EVV is, it is only one aspect of managing your home care agency. You should consider your EVV vendor to be a partner in the journey of your home care agency. 

The following is a recommended list of criteria that you may consider when choosing your EVV vendor:

  • Is the software easy to use, especially for my caregivers?
  • Does the vendor provide training and support when I need it, or do they expect me to "do it myself?"
  • Can the software bill all my payers and enable me to comply with EVV in the state?
  • Does the system provide reports and dashboards to help me optimize my business and grow?

What’s Happening with Indiana Medicaid and EVV

Indiana has chosen the open model for EVV compliance to the  21st Century Cures Act . On Tuesday, November 26, 2019 the In.gov/Family & Social Services Administration website announced an extension to EVV (electronic visit verification) requirements. “The 21st Century Cures Act directs state Medicaid programs to require personal care service and home health service providers to use an electronic visit verification (EVV) system to document the services rendered. See Indiana Health Coverage Programs (IHCP) Bulletins BT201951 and BT201855 for more information.

Indiana Medicaid EVV

“In accordance with this federal requirement, the Indiana Health Coverage Programs (IHCP) worked toward implementing an EVV system by January 1, 2020. However, after receiving input from the provider community, the Indiana Family and Social Services Administration (FSSA) submitted a good faith exemption request to the Centers of Medicare & Medicaid Services (CMS) to extend the soft launch of EVV. This would allow additional collaboration with affected providers and individuals to ensure a successful EVV implementation for Indiana. The Centers for Medicare & Medicaid Services (CMS) approved Indiana’s request (see letter of approval attachment), which extends the EVV soft launch through December 31, 2020.” Read more about these changes.

While the State has additional time to meet the federal EVV requirement, providers are strongly encouraged to continue taking steps now to be ready by January 1, 2021. Providers need to determine whether they would like to utilize the State’s EVV solution, Sandata, or an alternative EVV solution.”

The IHCP (Indiana Health Coverage Programs) Has Chosen a State Sponsored System

The IHCP (Indiana Health Coverage Programs) has chosen Sandata as the State-sponsored system for the implementation of federal EVV requirements. Indiana health care providers may choose to use an EVV system other than Sandata, such as Rosemark. These providers will be required to export data from their alternate system to the Sandata “Aggregator” for integration with CoreMMIS. This is an open vendor model. The important distinction is that Rosemark will be integrating with Sandata so that exporting will not be necessary.

Indiana Medicaid EVV Information

When did EVV start in Indiana?

The 21st Century Cures Act directs Medicaid programs to require personal care service and home health service providers to use an electronic visit verification (EVV) system to document services rendered. In the summer of 2020, the implementation date for requiring the use of an EVV system for personal care services was delayed to January 1, 2021 . The implementation date for requiring the use of an EVV system for home health services remains January 1, 2023

What EVV systems can I use?

The 21st Century Cures Act directs Medicaid programs to require personal care service and home health service providers to use an electronic visit verification (EVV) system to document services rendered. Indiana has selected Sandata as an EVV provider system. The Sandata EVV system is Health Insurance Portability and Accountability Act(HIPAA)-compliant and incorporates verification of the federally mandated data elements.

Alternate EVV Systems for Indiana

Providers may choose to use an EVV solution other than Sandata; however, providers will still be required to export data from their selected system to Sandata’s “Aggregator” for integration with CoreMMIS. This requirement will be necessary for documentation, billing, and reimbursement purposes.

The mission of the Indiana Department of Labor is to enhance the safety, prosperity, and health of employees in the workplace. Most Indiana employers and employees are guided by the minimum wage and overtime provisions of the federal Fair Labor Standards Act (FLSA). Some of which are:

  • The Indiana government has no laws specifying caregivers' timing and duration of meal breaks.
  • A caregiver in Indiana may be entitled to overtime pay if the employer has more than 40 employees. Overtime pay is calculated by dividing the weekly salary by 40 to get a regular hourly rate and multiplying by 1.5.

Section 1903(l)(5)(A) states that the chosen system must be able to electronically verify for visits conducted as part of personal care services or home health care services for the following:

IHCP releases updates related to the EVV implementation periodically. A survey was rolled out in April 2019 to develop a decision for helping agencies with the implementation deadlines. The survey also identified the types of EVV systems the home care businesses are using in Indiana, their preparedness, and their willingness to participate in a pilot. Training began in early fall 2019.
