The collapse of a luxury boat charter company operating off Western Australia's coast has devastated passengers with some demanding tens of thousands of dollars compensation.

Island Escape Cruises NZ, which cancelled a series of 12-day voyages, is in the hands of receivers Calibre Partners NZ.

The company's 53.5 metre superyacht, Island Escape, has been impounded at Broome Port, with a federal court order restricting its movements and operations.

Queensland man Murrie Taylor was booked to go on a cruise in early July from Broome, but said his trip to paradise quickly turned into a nightmare.

He and other passengers were waiting in his hotel lobby to be collected by the cruise company.

When he queried why the bus was late, he was told it would not be picking up passengers.

"We were gobsmacked basically," he said.

"We were left stranded … and we had no accommodation that night."

Passengers fear for refunds

Mr Taylor said he had paid about $30,000 for the trip when he and his wife had to spend thousands more on emergency accommodation and flight changes after cancellations left them stranded in Broome.

"It's not only the financial cost, it's the burden of the heartache it's caused a lot of people and it's just disgusting," he said.

Naomi Hunter and her husband, both from NSW, said they spent nearly $30,000 on tickets for a trip in August that never happened.

Ms Hunter said she was worried their money would not be returned.

"Whether we will ever be eligible for anything, I don't know," she said.

'No cash' to pay refunds 

Other customers vented their frustration on the company's Facebook page, which has since been taken down, warning would-be travellers against booking future cruises.

Calibre Partners NZ representative Neale Jackson said refunds were unlikely at this stage.

"We do not yet know what led the company being in this position," Mr Jackson said.

"It cannot pay any refunds because it does not have any cash to do so.

"The company did not employ any staff at the date we were appointed, so [as far as we understand] there are no claims for wages."

Mr Jackson said the customers would join a list of the company's other unsecured creditors.

"We expect that money customers are owed will rank as an unsecured claim against the relevant company," he said.

He also said there was another entity of Island Escape Cruises that was not in receivership.

"One thing to note is that we are receivers of two entities domiciled in New Zealand; Island Escape Cruises (NZ) Ltd and Seasons Shipping Ltd," he said.

"We are not receivers of the entity domiciled in Australia [Island Escape Cruises (Australia) Pty Ltd]."

Customers start legal action

Mr Taylor said a lack of communication from the company and it's chief executive Erik Helseth had added to his distress.

"After about seven attempts to contact them, he answered the phone," Mr Taylor said.

"He apologised and said that all persons would get a refund … I never heard from him again."

Ms Hunter said she was also left feeling confused after paying about $30,000 to the company.

"We felt like we were really on a bit of a limb," she said.

"I didn't know who to reach out to."

COVID-19 border restrictions made it difficult for tourists to book travel insurance in WA, leaving many of the travellers relying heavily on refunds.

"Because of COVID and the border crossings, it was extremely hard for an Australian resident to get travel insurance for a trip within Australia," Mr Taylor said.

"We've actually started some legal action against Island Escape Cruises Australia to see if we can recoup any money," he said.

The ABC has made attempts to contact Island Escape Cruises NZ for a comment but has not received a response.

This morning we take the 2-hour ferry ride over to Heron Island.

Heron Island is a natural coral cay located in the Great Barrier Reef, 80kms off the coast of Queensland near the Tropic of Capricorn. The Island is small enough to walk around in 20 minutes, yet it has everything you could wish for: a restaurant to satisfy healthy appetites, a deep resort swimming pool backing onto a bar and an abundance of wildlife that will truly amaze.

This morning we depart Rockhampton and head north through Mackay and onto Proserpine. From Proserpine, we head towards Airlie Beach where we board our Cruise Whitsundays transfer to Hamilton Island ready for our two night stay at the Reef View Hotel.

Today we depart for a cruise to Whitehaven Beach. The cruise is a leisurely half day scenic cruise to this magnificent beach. Your cruise vessel has expansive seating areas inside and out and your friendly skipper will provide an informative commentary on the history and natural wonders of the area.

Once at the beach, sink your toes into the fine white silica sands of Whitehaven and enjoy the warm, crystal clear waters. This is Mother Nature at her best! Back on the vessel, sit back, breathe in the sea air and marvel at the 74 Island Wonders of the Whitsundays.

Later today at Hamilton Island, you might like to jump on a shuttle bus and tour around the island. The shuttles circuit the island all day stopping at key attractions, scenic points and resorts, so hop on and off as you please. Enjoy a wander along the waterfront of Hamilton Island’s famous Front Street and Marina Village taking in the sights, visiting the galleries and doing some shopping.

This morning we cruise back to Airlie Beach and travel north to Proserpine and onto Townsville.

Regarded as the capital of North Queensland, Townsville has a regional population of around 160,000. After lunch along ‘The Strand’ we take the ferry across to Magnetic Island.

Enjoy a tour of the island and explore the sights and beaches including Arcadia Bay. We travel back to the mainland in the afternoon and spend the night at Ville Resort. Meals (B.L.D)

Today we catch the ferry back to the mainland and enjoy a visit to the Maritime Museum. This was established in 1986 when the Townsville Harbour Board proposed to the Seafarers Association to set up a nautical display. Funded by a Federal grant for capital works, the Museum complex was architecturally redesigned with a footprint in the shape of a ship to include a viewing deck along with new and improved galleries, a memorial garden, model ship gallery, WW2 history, and the original bell of the steamship Yongala which disappeared off the coast in March 1911.

In 2007 HMAS Townsville, a Fremantle Class Patrol Boat, was also gifted to the Museum by the Commonwealth Department of Defence.

After some morning tea we depart Townsville and continue our journey north. Pass through Ingham and Cardwell before arriving at Mission Beach where we spend the night at Castaways Resort and Spa, located on the waterfront. Enjoy time for a stroll along this sensational beach before dinner overlooking the Coral Sea. Meals (B.L.D)

After departing Mission Beach this morning we visit Paronella Park, home to one of Australia’s earliest hydro power systems. Built in the 1930’s to provide entertainment to the public, the park featured tennis courts, a cinema and even a ballroom inspired by Spanish castles. This fascinating historic site is now heritage listed and a highlight of your visit to north Queensland. Later this morning we continue north and head up into the Atherton Tablelands for a visit to Millaa Millaa Falls. This afternoon we continue on to Mareeba, Mt Molloy and Port Douglas. We arrive at the fully refurbished Sheraton Grand Mirage Resort late this afternoon where we will spend the next two nights. Meals (B.L.D)

This morning we make our way to the Marina Mirage where we board the Quicksilver ‘Wavedancer’ Catamaran. Enjoy an informative talk by a marine biologist before heading out for the blue waters of the Low Isles in the Coral Sea.

Set like a jewel in a Great Barrier Reef Lagoon, Low Isles is an idyllic and unspoilt coral island. The clear and calm lagoon waters are ideal for snorkelling and swimming. Visitors are limited to protect the reef’s ecology, so the whole of this beautiful, palm fringed island beach is yours to explore and enjoy!

Late this afternoon we return to the Sheraton Grand Mirage Resort in Port Douglas and prepare for the final night of this amazing journey - the unique ‘Flames of the Forest’ rainforest dining experience, located a short drive out of town. Meals (B.L.D)

This morning, enjoy a one hour cruise on the Daintree River with an expert guide who will share their intricate knowledge of the local ecosystem before heading south to Cairns where you will be transferred to the airport or to your accommodation if staying on in Cairns. Meals (B.L)

Island Escape Cruises ship arrested in Broome

Island Escape Cruises’ ship  Island Escape has been arrested in Broome after a warrant was put out by Bank of New Zealand and Export Finance Norway.

The cruise ship sailed from New Zealand to Broome in May and was meant to make a series of 12-night ‘Wild Kimberley Coast’ 2022 round cruises from the northern WA town, but cancelled three.

There has been some mystery surrounding the company after Island Escape Cruises’ founder Peter Bissett reportedly resigned earlier this month and sales coordinator Nikita Smith also departed, leaving the cruise lines director Erik Helseth to take over as CEO.

Travel Weekly called Island Escape Cruises for comment but there was no response.

When a cruise ship is arrested, it is seized by authorities usually due to financial irregularities, and the ship does not operate until the underlying issue(s) at hand are dealt with.

At the beginning of the year, two Crystal Cruises ships diverted course to the Bahamas to avoid an arrest warrant put out on them by US authorities. Crystal Serenity went to the Bahamas less than a fortnight in the wake of its parent company filing for liquidation, after Crystal Symphony was set to dock in Miami but diverted to the Bahamas after a federal judge issued an arrest warrant for the ship.

32-passenger superyacht Island Escape sold to pay back creditors

A premium cruise ship deployed in Australia's Kimberley region has been sold to repay its creditors, but it is unlikely that $4 million owed to unpaid customers will be returned.

Island Escape Cruises NZ left numerous customers in a financial bind after abruptly canceling voyages along the Kimberley coast last year. Shortly after the cancellations, the company went into receivership, and the vessel was seized at Broome Port (Western Australia) .

According to a recent report submitted to the creditors, the luxurious 54-meter/175-ft superyacht was sold for AU$5.5 million, which is significantly lower than its estimated value (~AUD 40M). The urgent sale was conducted by the Federal Court in order to reimburse international creditors, namely the Bank of New Zealand and Eksfin/Export Finance Norway.

Unfortunately, due to the underselling of the vessel, unsecured creditors are unlikely to receive refunds for their canceled vacations. Island Escape Cruises NZ, led by Erik Helseth, went into receivership in August, and subsequent investigations into the company's finances were initiated. The company had promised 12-night cruises along the Kimberley coast, and the news of the cancellations devastated many customers.

The boat Island Escape was seized by the Federal Court marshal, and an urgent sale was ordered on November 30th. On January 13th, it was sold to the Paspaley Group for the highest bid of $5.5 million, and the transfer of ownership took place on February 22nd.

EXCLUSIVE: The travel plans of guests booked to sail with Island Escape Cruises in the Kimberley have been thrown into disarray after the small-ship operator is understood to have cancelled last weekend’s sailing at the 11th hour.

Island Escape Cruises operates one luxury yacht – the aptly named Island Escape – which entered service in New Zealand earlier this year. Having already operated a number of sailings in the Kimberley since May, booked passengers are currently venting their fury on social media at the sudden and unexplained suspension of Sunday’s sailing, terminated within 24 hours.

Feedback from impacted guests shared on Island Escape Cruises’ Facebook page indicates there was no forewarning that their 3 July cruise would not be proceeding, with some guests either already in Broome or in transit to the Western Australian city in anticipation of boarding the intimately sized 30-guest ship.

According to Island Escape Cruises’ website, the 12-day Wild West Coast voyage operating round trip from Broome was sold out. As are the subsequent three sailings on 16 and 28 July and 10 August, while two further sailings on 22 August and 4 September have “limited availability”.

Comments made on social media suggest the vessel arrived in Broome on Sunday morning, offloaded guests, before disembarking the wharf without its next boat load of cruisers.

One guest who sailed earlier in the season aboard Island Escape told LATTE “ many aspects of this cruise were disappointing.”

While the yacht itself was “great the crew was brand new, had no experience of the Kimberley’s. No tour guide. There was only one zodiac and no helicopter as described in brochures,” the guest said.

Attempts by LATTE to verify the situation for the 3 July departure, and the remaining Kimberley season with Island Escape Cruises’ CEO/Director, Erik Helseth, were left unanswered. Meanwhile, an automatic email response to former Owner Peter Bissett, states “I resigned from the company on 4 July 2022”.

LATTE understands that some past passengers are considering mounting a class action against Island Escape Cruises.
