What is a break of journey.

Did you know that with many tickets in Great Britain, it’s possible to use one ticket and break up your journey as you wish? Let’s take a look at break of journey, what it means and when you can do it.

In a railway sense, a break of journey is when you interrupt your trip part-way through. For example, if you’re travelling from London to Birmingham, then choose to get off in Coventry and visit some friends for a couple of hours, then this is a break of journey.

If you’re just changing trains or using the facilities at the station, then this isn’t a break of journey. For example, you might have 30 minutes between trains and choose to visit a shop on the station concourse.

How long can a break of journey last for?

You can break your journey for as long as your ticket is valid. For example, if you have a day return , you’d need to complete your journey by 04:30 the next morning.

If you have an Off-Peak Return , then you need to complete your outward journey on the same day. You can break your journey on the way back as many times as you like within one month, so long as you don’t ‘double back’ and keep travelling in the same direction. There’s no requirement to complete your journey on the same day.

An Anytime Return has similar rules, but you can use the outward part of your ticket for five days. An Anytime Single is valid for two days.

Finally, if you can’t reasonably complete your journey within the validity of the ticket, and need to stop overnight, you can do this. However, you need to complete your journey the following day, with no further breaks allowed, other than to change trains.

Which tickets allow a break of journey?

Most flexible tickets allow you to break your journey. This includes all tickets marked as ‘ Anytime ‘. When it comes to tickets that are either Off-Peak or Super Off-Peak , it can vary. You can always break your return journey, but some tickets don’t allow you to do this on your outward journey.

You can find this out by checking which restriction code your ticket has. You’ll find this at the bottom of your ticket if it’s an eTicket:

When you follow the link , it’ll tell you what the restriction code means. If it does not mention breaking your journey, then there aren’t any restrictions.

Can I break my journey with an Advance ticket?

Breaking your journey isn’t possible with an Advance ticket. This is because you need to stick to the trains you’ve booked, and complete the journey in one go.

Remember, changing trains and using the facilities at the station doesn’t count as breaking your journey. If you have a long connection and want to be let through the ticket gates to pop to a shop in the station, you should be allowed to do this.

What if a member of staff writes the date on my ticket?

If you have a paper ticket, staff might mark the date on it. This usually happens if you have a return ticket where the return part is valid for a month. This doesn’t affect how long the ticket is valid for and doesn’t mean that you have to complete your entire journey on that day.

Any markings on the ticket do not change how long it’s valid for.

The Indian Railways offers the facility of break journey to its passengers during long-distance journeys. The option is available on single journey tickets that are for a distance of at least 500 kilometers. For distances upto 1,000 kilometers, only one break-journey is permitted, and for longer distances, two break-journeys are allowed. Here's all you need to know about break-journey rules.

Rules about period of break journey and exceptions

The period of break journey that can be availed at a station is upto a maximum of two days, excluding the days of departure and arrival of the train. Break of journey is not allowed on certain trains such as Rajdhani Express, Shatabadi Express etc., since these trains have separate all-inclusive fare structure on point-to-point basis.

Rules about ticket endorsement, intention of break-journey

Passengers are needed to have their tickets endorsed at the station of journey-break. The endorsement must consist of station code, station master's initials and the date of journey break. In case a passenger doesn't obtain such endorsement, they shall be treated as traveling without a proper ticket. The intention for break-journey must be advised at the time of ticket booking, not after getting reservation.

If you have a single ticket for a journey, and this journey will cover a distance of more than 500 kilometers, you will be allowed to break your journey once for two days at any station en-route. You can avail this facility only after traveling 500 kilometers from the starting station.

If you are going to travel for a distance of more than 1000 kilometers, you can enjoy parting your trip twice. Only you have to remember the departure and arrival date. Exclude these days while calculating the number of eligible days for first break of your journey. Ticket should be endorsed by the station manager/ticket collector at the station where this journey is intended.

IRCTC does not allow this facility to passengers who have booked their tickets in Shatbadi/ Rajdhani/Jan shatbadi express trains. However, for booking tickets in other express trains, you will need to inform the ticket booking office about your intention of traveling in intervals at the time of booking your ticket as you cannot avail this facility after getting the reservation.

Important Notice – Blow is key information about the rules of break journey. Know them if you want to enjoy this facility:

• You cannot enjoy the break journey facility if you want to book a single ticket for 800 kilometers and want to have a pause in your trip for two days at 423 kilometers.

• You can be permitted once for maximum 2 days stoppage at 501 kilometers only if you have a ticket for 600 kilometers.

• If you have a single journey ticket for 1050 kilometers and you want to break your travel at 400 kilometers and 801 kilometers, you will be given only one break at 801 kilometers for maximum of 2 days.

• If you have a single ticket for the journey of 2000 kilometers and you want a break  at 800 kilometers, 905 kilometers and 1505 kilometers, then you can have only two break journey depending on your per choice at the rate of two days maximum at each point of break journey.

What is break journey.

When a passenger discontinues his journey between his starting station and destination station for any reason at one station or more than one station and again starts his journey for his destination station it is called a break journey.

Break Journey rules on single journey ticket

  • The total distance of journey ticket should be more than 500 km.
  • First break journey will be allowed after completion of 500 kms from the starting station.
  • UP to 1000 kms only one break journey will be granted to the passenger.
  • If the total distance is more than 1000 kms two break journey will be granted.
  • At one break journey point, passengers can stay a maximum of two days excluding the date of arrival and date of departure.
  • Endorsement on the ticket is necessary. Without endorsement, the passenger will be treated as without ticket passenger.7. If a passenger halts at an intermediate station for less than 24 hrs. to catch a connecting train, it will not be treated as a break journey.

Break Journey rules on return journey ticket

Both portions of journey ticket are treated as single journey ticket and the rules of break journey provided for single journey will be applicable on both portion of journey ticket.

Break Journey on monthly season tickets

Monthly Season ticket holders are permitted to break joumey at any station between the two stations for which the season ticket is held. Endorsement is not necessary and there is no any distance restriction.

Break Journey rules on MVST

The MVST holders are allowed to break their journey once enroute on outward trip but that station will be treated as journey terminating station for that day only, as train number is mentioned on this ticket.

Break Journey rules on cheque pass

Cheque pass holders are allowed to break their journey only at that station mentioned on ths pass. Endorsement is necessary on the pass.

Brake journey rules on indrail pass + Tourist coupon ticket

Indrail pass and tourist coupon ticket holders are permitted to break journey at any station. Endorsement is not required in case of Indrail pass but it is required in case of tourist coupon ticket.

Break Journey rules on circular journey ticket

Circular journey ticket holders can break their joumey as per their programme. Maximum at 8 points break journey can be taken but the journey should be completed within its validity period. Endorsement is not necessary.

  • .Break journey enroute at a station on an alternative longer route is not allowed.
  • The holder of MST, QST, MVST, Tourist coupon ticket, ICCRP, circular journey ticket and card pass may break journey at any station enroute without any restriction.
  • Cheque pass holders may break their journey only at the station shown on the pass by the issuing authority
  • Suburban ticket holders and metal token holders are not allowed to break their journey.
  • Break journey is not permitted on tickets issued to released convicts on jail requisition.
  • Members of railways users consultative committee travelling on passes can break journey any where en route.
  • Foreign tourist can break journey enroute without any distance restriction on Indrail pass.
  • Break journey is not allowed on Rajdhani and Shatabdi express and also Janshatabdi.
  • A holder of a ticket exchanged for P.T.O. travelling by mail/express train can break journey enroute without distance restriction.

If you are traveling on a train on a single journey ticket for a distance of more than 500 kilometers, you are allowed to break journey once for two days at any station en-route. However, the facility is not available to passengers traveling by Rajdhani/Shatbadi/Jan Shatbadi express trains.

Here are the break journey rules and guidelines issued by Indian railways:

# This facility can be availed only after traveling 500 kilometers from the starting station. For example, if a passenger with single journey ticket for 800 kms wants to break his/her journey at 423 kms, it is not permissible.

# If the ticket is for more than 1000 kms, a passenger will be allowed to break journey twice. For instance, a passenger with single journey ticket for 600 kms wants to break his journey at 501 kms, he/she will be permitted only once for a maximum period of two days. That means the passenger can detrain at a mentioned station en-route for two days, before resuming his/her journey.

# If a passenger with single journey ticket for 1050 kms wants to break his journey at 400 kms and 801 kms, then only one break journey at 801 kms is permitted for maximum two days.

# Two break journeys will be permitted only when the distance is too long. For example, a passenger with single journey ticket for 2000 kms wants to break journey at 800 kms, 905 kms, and 1505 kms, two break journeys will be permitted as per the choice of a passenger at the rate of two days maximum at each point of break of journey.

# Meanwhile, the day of departure and arrival must be excluded while calculating the number of eligible days for the first break of journey and ticket should be endorsed by the station manager/ticket collector at the station where the break journey is intended. The endorsement shall consist of the Station Code, Station Master’s initials and the date.

# Break journey shall not be permitted short of the station up to which reservation has been done. If a passenger seeking reservation on through tickets asks for break journey en route it should be clearly indicated on the Requisition form the names of the station where the break journey is requested. Reservation, in this case, will be done up to break journey station only.

# Intention to break journey is to be advised at the time of original booking and not after obtaining reservation.

# Whenever a through passenger detrains at a station en-route for catching a connecting train, it should not be treated as break journey provided such halt is for less than 24 hours. For example, the holder of a direct ticket from Pune to Jammu Tawi via Dadar travels from Pune to Bombay by any day train a day earlier in order to catch Bombay-Jammu Tawi Express next morning leaving Bombay at 6.25 hours shall not be treated as break journey.

# Passengers breaking the journey en-route must surrender their tickets at the station where the journey is broken. Refund for the untravelled portion on such tickets will be allowed in special circumstances only subject to the condition laid down in Rule 213,4 and provided also that the procedure given in that rule is followed.

A FEW POINTS TO NOTE:

# Passengers breaking a journey and not obtaining the endorsement as prescribed will be treated as persons traveling without a proper ticket and dealt with accordingly.

# Break of journey is not permissible on the tickets of certain trains like Rajdhani Express, Shatabdi Express, etc., which have separate all-inclusive fare structure on a point-to-point basis, and therefore, refund on such partially used tickets is also not admissible.

How to Book Break Journey Rail Tickets

Are you planning for a long journey and also want to utilize break journey feature provided by Indian Railways for us so that in the same ticket we can halt over some stations only to continue later?

Why would we want do a Break-Journey? It saves lot of money. If you were to book separate tickets then the fare will be way more than the break-journeyed tickets. Indian railways charges you for a telescopic distance in case of break journey tickets. Additionally you save yourself from booking multiple tickets and additional burden of Rs. 40-60 cancellation charges per person on separate tickets.

My break journey.

Here I want to show you how I’ve booked break journey ticket for a journey for my family in Sept., 2011 from Vishakapatnam- Nizamuddin - Dehradun. So along with break journey it looks like Vishakapatnam- [Durg] - Nizamuddin - Dehradun. That means I want to do a break journey at Durg which is more than 600 km from source station Vishakapatnam. Also Durg falls into the train route. Please keep in mind the Nizamuddin is in New Delhi only so we'll get down at Nizamiddin station and board the train for Dehradun from New Delhi station.

Ok so you want to book it quickly as soon as possible? We can’t book it from IRCTC. We need to book it only from the reservation counter. Let me show how I booked my tickets and it’ll then be clear to you.

So my trip looks like this: Vishakapatnam- [Durg] - Nizamuddin - Dehradun:

  • Board at Vishakapatnam
  • Get down at Durg ( this is called break journey)
  • After two days catch any other or the same train from Durg to Nizamuddin
  • Get down at Nizamuddin(this is actually in New Delhi)
  • Go to New Delhi station
  • Board train at New Delhi for Dehradun
  • Reach Dehradun

A limitation seems to be that your all tickets should be in the same class. That is you may not travel in Sleeper in one hop and 2AC in another.

How I filled the Ticket Booking Form

I filled two forms. In the first, boarding station is Vishakapatnam and next journey is from Durg to Nizamuddin. See the red circled portions in the ticket for below.

In the second form I’ve just filled my journey details from Nizamuddin to Dehradun.

The rail clerk made the booking, booking a ticket, noting its reference number and using it in the next tickets. So finally I got 3 tickets whose fare was calculated at discounted rate as per Indian Railways Telescopic distance calculation and I saved lot of money.

Indian Railways offers Circular Journey Tickets for pilgrimages or sightseeing, providing unique travel flexibility by allowing trips that start and end at the same station, excluding regular routes.

Circular journey Tickets can be purchased for all classes of travel . A maximum of ✅ eight break journeys will be admissible on these tickets. Standard Circular Journey Tickets are also offered by Zonal Railways . These cover popular destinations for the Convenience of tourists.

The details of route, fare etc., for these tickets can be obtained from nominated stations in each Zonal Railway. You can purchase these tickets if any one of the standard routes suits your convenience. Otherwise you can inform the Zonal Railways about your itinerary and Circular Journey Tickets can be drawn up to suit your requirements.

Rules of Booking a Circular Journey Ticket s

  • Normal rules on Break Journey will not apply in case of Circular Journey Tickets for such circular journey which commences and completes at the same station. Return Journey on the shortest route or on a route up to 15% longer than the shortest route will not be treated as a circular journey for this purpose. Circular Journey Tickets can be issued for all classes. Before issuing a Circular Journey Ticket, the passenger should be asked to advise the names of a maximum of eight stations (excluding originating/destination station) where he wants to break the journey.
  • Validity period – The validity period for the ticket will be calculated at the sum of journey days and break journey days – journey days to be calculated @ 1 day per 400 km distance or part thereof and break journey days to be calculated @ 1 day per 200 Kms. The ticket will be valid from the day of the journey indicated on the ticket. There will be no restriction on commencing the break journey. The passenger will be required to put his signature with the date on the ticket on the commencement of the journey.
  • Break Journey – On a circular journey ticket the maximum number of break journeys will be 8 (eight). The endorsement of break-journey is not required on Circular Journey Tickets.
  • Fare for Circular Journey ticket – The circular journey ticket will be charged for two single journeys, each journey being taken as half of the total distance. Reservation charges for different legs of journeys, the supplementary charge on super-fast, etc. will be levied extra. If a passenger travels in a higher class or by a higher category of trains, he will be required to pay the difference of fares for such distance on point to point basis.

Standard Circular Journey Tickets are issued for all journeys which begin and end at the same station. The salient features are:

  • This facility is suitable for passengers travelling ✅ individually or in groups ; especially for passengers traveling on a pilgrimage or a sightseeing tour.
  • Available for all classes of travel in Mail/Express fares only.
  • Issued according to your own itinerary , these tickets give you unique travel flexibility.
  • Fares levied as per your itinerary —allowing you the benefit of telescopic fares , which are lower than point to point fares.
  • Circular journey tickets also save you time and the inconvenience of booking tickets at each leg of the journey. Only a maximum of eight break of journeys will be admissible on this ticket.

Advantages of Booking a Circular Journey Ticket s

  • Fares levied as per your itinerary —allowing you the benefit of telescopic fares , which are lower than point to point fares.These rates are calculated on Mail/Express Fares.
  • Circular journey tickets save your time .
  • And it helps to avoid the inconvenience of booking tickets at each leg of the journey.
  • Only a maximum of eight break of journeys will be admissible on this ticket.
  • Once your itinerary is finalised, you can approach the ✅ Divisional Commercial Manager of the Division of certain major stations to which the journey commencing station belongs.
  • The Divisional Commercial Manager or the station authorities will then calculate the cost of the tickets based on your itinerary. He will also inform the ✅ Station Manager of the same in a prescribed format .
  • You can purchase Circular Journey Tickets by presenting this form at the ✅ Booking Office of the station where you propose to start your journey.
  • After purchasing the Circular Journey Ticket, you must approach the ✅ Reservation Office to reserve your accommodation for various laps of your journey.
  • You will then be issued reserved journey ticket for the journey.
  • A Circular Journey Ticket is charged for as ✅ two single journeys, the length of each single journey being taken as half of the total distance.
  • 40% concession for male Senior Citizens and 50% concession for female Senior Citizens are granted on the cost of the Circular Journey Tickets when travelling a minimum distance of 1000 kms.

Issue of ✅ Non- Standard Circular Journey Tickets

Apart from standard circular journey tickets, East Coast Zone also issues non standard cirlcular journey tickets for journeys commencing and terminating at stations under its jurisdiction. ✅ Applications for non-standard circular journey ticket can be sent to any of the following office of the:

  • Chief Comml Manager, East Coast Railway, Chandrasekharpur, Bhubaneswar
  • Divisional Railway Manager (Comml.) at Waltair, Khurda Road and Sambalpur.

Station Manager at Bhadrak, Bhubaneswar, Jajpur Keonjhar Road, Puri, Sambalpur, Sambalpur Road, Srikakulam Road, Titlagarh, Brahmapur, Khurda Road, Cuttack, Vizianagaram, Rayagada, Hirakud, Bolangir, Mahasamund, Kesinga,and Visakhapatnam of East Coast Railway.

The authority letter may be obtained against your application from the above offices/stations in respect of non standard circular journeys tours and presented at the booking office to procure the journey tickets on payment of requisite fare and other charges.

The distance restriction for booking of passengers by selected trains over this railway will be applicable to the holders of standard and non standard circular journey tickets.

✅ Circular Journey Tickets Southern Railways

No Standard Circular Journey Tickets are issued by Southern Railways, only non-standard Circular Journey Tickets as per the itenary given by the passengers are issued by the Southern Railways.

Break of journey is not permissible on the tickets of certain trains like rajdhani express, shatabdi express, etc. which have separate all-inclusive fare structure on a point-to-point basis..

New Delhi: Indian Railways is one of the largest railway networks in the world. Break of journey, at en-route station, is permitted only on those single journey ticket which are for more than 500 Kms. The first break of the journey shall not, however, be admissible until a distance of 500 km. has been travelled from the starting station. Only one break-journey will be permitted on tickets up to 1,000 Kms. and maximum of two break-journeys will be allowed on tickets of longer distances. 

The period of break-journey that can be availed at a station will be up to a maximum of 2 days only excluding the day of arrival and the day of departure of the train. For all return tickets, each half of the tickets is treated as a single journey ticket. It may be noted that break of journey is not permissible on the tickets of certain trains like Rajdhani Express, Shatabdi Express, etc. which have separate all-inclusive fare structure on a point-to-point basis, and therefore, refund on such partially used tickets is also not admissible.

If you are not boarding or de-boarding the train as per your tickets, here are break journey rules that you need to know

IRCTC break journey

1. Whenever a passenger detrains at a station en-route for catching a connecting train, it should not be treated as break journey provided such halt is for less than 24 hours. For example, the holder of a direct ticket from Pune to Jammu Tawi via Dadar travels from Pune to Bombay by any day train a day earlier in order to catch Bombay-Jammu Tawi Express next morning leaving Bombay at 6.25 hours shall not be treated as break journey.

2. Passengers are required to have their tickets endorsed at the station where the journey has been broken. The endorsement shall consist of the station code, station Master's Initials and the date.

3. Passengers breaking the journey and not obtaining the endorsement as prescribed will be treated as persons travelling without a proper ticket and dealt with accordingly.

4. Passengers breaking the journey en route except as provided above must surrender their tickets at the station where the journey is broken and obtain Ticket Deposit Receipt (TDR). Thereafter, they should act in accordance with the instructions on TDR for claiming a refund for the untravelled portion on such tickets. 

5. Break journey shall not be permitted short of the station up to which reservation has been done. If a passenger seeking reservation on ticket wants to break journey enroute, it should be clearly indicated on the Requisition form the names of the stations where the break journey is required.

Arizona Supreme Court rules a near-total abortion ban from 1864 is enforceable

PHOENIX — The Arizona Supreme Court ruled Tuesday that a 160-year-old near-total abortion ban still on the books in the state is enforceable, a bombshell decision that adds the state to the growing lists of places where abortion care is effectively banned.

The ruling allows an 1864 law in Arizona to stand that made abortion a felony punishable by two to five years in prison for anyone who performs one or helps a woman obtain one. 

The law — which was codified in 1901, and again in 1913 — outlaws abortion from the moment of conception but includes an exception to save the woman’s life.

That Civil War-era law — enacted a half-century before Arizona even gained statehood — was never repealed and an appellate court ruled last year that it could remain on the books as long as it was “harmonized” with a 2022 law, leading to substantial confusion in Arizona regarding exactly when during a pregnancy abortion was outlawed.

The decision — which could shutter abortion clinics in the state — effectively undoes a lower court’s ruling that stated that a more recent 15-week ban from March 2022 superseded the 1864 law.

The Arizona Supreme Court said it would put its decision on hold for 14 days, writing that it would send the case back to a lower court so that court could consider “additional constitutional challenges” that haven’t yet been cleared up.

Attorney General Kris Mayes, a Democrat, said moments after the ruling that she would not enforce the law.

“Let me be completely clear, as long as I am Attorney General, no woman or doctor will be prosecuted under this draconian law in this state,” Mayes said in a statement, adding that the decision was “unconscionable” and “an affront to freedom.”

Democrats all the way up to President Joe Biden also blasted the ruling.

“Millions of Arizonans will soon live under an even more extreme and dangerous abortion ban, which fails to protect women even when their health is at risk or in tragic cases of rape or incest,” Biden said in a statement. He called the ban “cruel” and “a result of the extreme agenda of Republican elected officials who are committed to ripping away women’s freedom” and vowed to “continue to fight to protect reproductive rights.”

Vice President Kamala Harris announced shortly after the ruling that she would travel to Arizona on Friday “to continue her leadership in the fight for reproductive freedoms."

Responding to questions from NBC News about the Arizona ruling, a spokesperson for Donald Trump's campaign referred only to the former president's comments on Monday that abortion restrictions should be left to states.

“President Trump could not have been more clear. These are decisions for people of each state to make," Trump campaign national press secretary Karoline Leavitt said.

Arizona Gov. Katie Hobbs called for the GOP-controlled Legislature, which is currently in session, to repeal the 1864 ban, though there was no immediate indication that Republican lawmakers in either chamber would take up such an effort.

"We are 14 days away from this extreme ban coming back to life," Hobbs, a Democrat, said at a press conference. "It must be repealed immediately."

While Hobbs said she was "sure" reproductive rights advocates would appeal the ruling in the 14-day window they were given, she also suggested that the best avenue to counter the ruling would be for voters to support abortion rights on the November ballot. A separate, ongoing suit would allow for abortion providers to continue providing services through the 15th week of pregnancy for another 45 days.

"It is more urgent than ever that Arizonans have the opportunity to vote to enshrine the right to abortion in our constitution this November. I’m confident that Arizonans will support this ballot measure, and I’m going to continue doing everything in my power to make sure it is successful," Hobbs said.

In a 4-2 ruling, the court’s majority concluded that the 15-week ban “does not create a right to, or otherwise provide independent statutory authority for, an abortion that repeals or restricts” the Civil War-era ban “but rather is predicated entirely on the existence of a federal constitutional right to an abortion since disclaimed” by the 2022 Dobbs decision that overturned Roe v. Wade.

“Absent the federal constitutional abortion right, and because” the 2022 law "does not independently authorize abortion, there is no provision in federal or state law prohibiting” the 1864 ban.

They added that the ban “is now enforceable.”

Tuesday’s ruling is the latest chapter in a decadeslong saga of litigation in the battleground state over abortion rights. 

Reproductive rights groups had sued to overturn the 19th century law in 1971. But when the Roe decision came down in 1973, a lower state court ruled against those groups and placed an injunction on the 1864 ban that remained in effect until the Dobbs decision.

In March 2022, Republican lawmakers in the state enacted the 15-week trigger ban, which, months later — after the Dobbs decision — snapped into effect. The law makes exceptions for medical emergencies but not for rape or incest. 

Litigation resumed after that decision as lawmakers on both sides of the issue sought clarity on whether to enforce the 1864 near-total ban or the 2022 15-week ban.

A state appellate court initially ruled that both the 1864 and 2022 laws could eventually be “harmonized,” but also said that the 15-week ban superseded the near-total abortion ban and put on hold large parts of the older law.

The decision also sent shockwaves through the reproductive rights community in Arizona and nationally.

Angela Florez, the president of Planned Parenthood Arizona, one of the state's remaining abortion care providers, said her group would now only be able to provide abortion care through the 15th week of pregnancy — and only "for a very short period of time."

The issue, however, could soon be in the hands of voters.

Abortion rights groups in the state are likely to succeed in their goal of putting a proposed constitutional amendment on the November ballot that would create a “fundamental right” to receive abortion care up until fetal viability, or about the 24th week of pregnancy.

If voters approved the ballot measure, it would effectively undo the 1864 ban that now remains law in the state. It would bar the state from restricting abortion care in situations where the health or life of the pregnant person is at risk after the point of viability, according to the treating health care professional.

That ballot effort is one of at least 11 across the country that seek to put the issue directly in the hands of voters — a move that has the potential to significantly boost turnout for Democratic candidates emphasizing the issue. 

In 2024, that could factor heavily into the outcome of both the presidential and U.S. Senate races in Arizona. Biden, whose campaign is leaning heavily into reproductive rights, won the state by just over 10,000 votes four years ago. And the Senate race features a tough battle to fill the seat held by the retiring independent Sen. Kyrsten Sinema, most likely between Democrat Ruben Gallego and Republican Kari Lake. 

During her unsuccessful 2022 run for governor in Arizona, Lake said she supported the 1864 law, calling it “ a great law that’s already on the books .” But Lake now says she opposes the 1864 law , as well as a federal abortion ban, while also acknowledging that her own views regarding state policy conflict with some voters’ preferences.

In a statement following the decision, Lake said she opposed the ruling, adding that "it is abundantly clear that the pre-statehood law is out of step with Arizonans." She called on state lawmakers to "come up with an immediate common sense solution that Arizonans can support."

"Ultimately, Arizona voters will make the decision on the ballot come November," she added. 

Gallego, who is backed by several reproductive rights groups, has said he supports the ballot measure. As a member of the U.S. House, he is among the co-sponsors of the Women’s Health Protection Act, which would create federal abortion protections.

In a video posted to X after the ruling, Gallego said he would, with reproductive rights supporters, "fight all the way to November so we can get abortion rights back for women in Arizona."

Other Republicans in the state who’d previously expressed robust support for Roe being overturned joined Lake in condemning the ruling. Reps. Juan Ciscomani and David Schweikert , who both face tough re-elections this fall, both called on state lawmakers to address the issue “immediately.”

The ruling Tuesday — the second in a swing state on the issue in as many weeks — further highlights the already prominent role abortion rights will play in Arizona and across the country.

Last week, the Florida Supreme Court upheld a 15-week ban on abortion in the state, which effectively meant that a six-week abortion ban, with exceptions for rape, incest and the life of the woman, that Gov. Ron DeSantis signed into law last year will take effect. The state's high court also allowed a proposed amendment that would enshrine abortion protections in the state constitution to appear on the November ballot.

Tuesday's decision, while jarring to reproductive rights groups, wasn’t entirely unexpected. All seven justices on the Arizona Supreme Court were appointed by Republican governors, and during opening arguments in December, they aggressively, but civilly, quizzed attorneys on both sides about the fact that the 15-week ban enacted last year did not feature any language making clear whether it was designed to repeal or replace the 1864 ban.

Only six justices participated in Tuesday’s decision, however, after Justice Bill Montgomery — who previously accused Planned Parenthood of practicing “generational genocide” — recused himself. (The court’s chief justice did not appoint another judge to take the spot, which is an option under Arizona law.)

The abortion landscape in Arizona has been uniquely confusing since Roe v. Wade was overturned. 

While the 1864 law had been on hold after the Supreme Court’s 1973 Roe decision, then-Arizona Attorney General Mark Brnovich, a Republican, successfully sued in 2022 to have that injunction lifted following the overturning of Roe, putting the ban back into effect — though a higher court put that ruling on hold. 

But after Mayes succeeded Brnovich as attorney general, she announced that she would not enforce the 1864 ban.

That led to suits from anti-abortion groups seeking enforcement of the ban, which ultimately led to the case making its way up to the state Supreme Court.
